Show SUMMONS IN THE DISTRICT COURT OF BEAVER COUNTY, UTAH CARL R. SCHWARTZ, Plaintiff, Plain-tiff, vs. WINIFRED R. TIMBERS, TIM-BERS, if living, and her unknown un-known heirs-at-law, if deceased, de-ceased, and all other persons unknown, claiming any right, title, estate or interest in, or lien upon the real property described de-scribed in the pleadings adverse ad-verse to the complainant's ownership, own-ership, or clouding his title thereto, Defendants. THE STATE OF UTAH TO THE ABOVE NAMED DEFENDANTS: DE-FENDANTS: You are hereby summoned and required to serve upon or mail to CLINE, JACKSON & McCOY, plaintiff's attorneys, whose address is Milford, Utah, an answer in writing to the said complaint and file a copy of said answer with the Clerk of the above entitled Court within 20 days after service of this summons upon you. If you fail so to do, judgment by default de-fault will be taken against you for the relief demanded in said complaint. which has been filed with the Clerk of said Court and a copy of which will be mailed to you within ten days after service of this summons sum-mons upon you. If your address is unknown to plaintiff or his attorneys, and the complaint is not attached at-tached to this summons, it will be filed within said ten days with the Clerk of the above Court and you may there obtain ob-tain a copy. This is an action to recover a judgment against you declaring declar-ing and determining that a certain cer-tain mortgage dated the 10th day of June, 1960, given by Western Farm Investment Company, Com-pany, an Arizona corporation, as mortgagor, to Winifred R. Timbers, mortgagee, and recorded re-corded on the day of June, 1960, in Book 21 of Mortgages at page 63 thereof, in the office of-fice of the County Recorder of Beaver County, Utah, to secure an indebtedness of $3,300.00, has been fully paid and satisfied; satis-fied; and declaring the premises prem-ises therein described as free from the lien of said mortgage, and to quiet title to said premises prem-ises as against all other defendants; de-fendants; That the premises described in the said mortgage are more particularly described as follows: fol-lows: The West one-half (W) and the Southeast quarter (SEi4) of Section Thirteen (13), Township Twenty-eight (28) South, Range Eleven (11) West, S.L.M., together with all appurtenances thereunto there-unto belonging, together with any and all water rights appurtenant thereto, including includ-ing but not limited to Underground Under-ground Water Claim No. 10324 on file in the office of the State Engineer of the State of Utah, representing a well right on said premises and Application No. 20304 on file in the office of the State Engineer of the State of Utah; together with any and all improvement s situated thereon; less ten acres of the above described tract consisting consist-ing of four hundred and seventy sev-enty acres of land.
