Show DISTRICT COURT HAS HEAVY CALENDAR District court convened in Beaver Bea-ver Wednesday of last week with about an average calendar of cases to be heard. Judge Will L. Hoyt presided, with Court Reporter Keller Kel-ler and Clerk C. Victor Smith also in attendance. First case heard was that of the State of Utah vs. Jack Duard Davis. In this case defendant was ordered to appear and show cause why he jshould 'not be punished for contempt con-tempt for failure to make payments orderd by the court. It appeared to the court that since its order, defendant had paid $180. Defend-dant Defend-dant will be required to appear on September 14 unless he be current in ordered payments. In the civil case of Nellie E. Carelock vs. Edgar Alex Carelock, defendant was" required to appear on this date with a record of his receipts and expenses. Defendant duly appeared, was sworn and examined. ex-amined. He was required to appear ap-pear again on September 14. In the case of F. D. Schuck vs. Ogden Smelting & Refining Co., case was set for trial September 14. Case of Morgan Evans vs. Annie B. Evans, Adm., came up for hearing hear-ing on motion of defendant to dismiss dis-miss the action. Motion was denied and defendant given 15 days ini which to answer. Case of Doris Dalton vs. Louis Dalton. Defendant did not appear.! Plaintiff was represented by Attorney Harold Cline. Restraining Restrain-ing order requiring defendant to pay $75 on July 10, 1959 and a like sum semi-monthly thereafter1 during pendency of action was continued. con-tinued. Court found that plaintiff was entitled to support for two minor children and was granted certificate and order of support. Case of Chlorene Walker vs. Sonny Walker. Harold Cline representing repre-senting plaintiff, who was sworn and testified. Case continued subject sub-ject to further order of the court. Grace D. Smith vs. Kenneth C. Smith, Patrick H. Fenton appearing appear-ing as counsel for plaintiff and Sam Cline for defendant. The de-fedant de-fedant moved the court to withdraw with-draw his answer and consented that plaintiff make her proof. Grace D. Smith was sworn and testified, tes-tified, after which case was taken under advisement. Omni Cartwright, Administrator, vs. Anna G. Waters et al. Harold Cline appeared for plaintiff and gave evidence in support of allegations allega-tions of complaint. Court found allegations al-legations to be true and ordered decree quieting title as prayed for. J. Delmar Kirk, Exec, vs. Susan Baxter et al. Case came on for hearing on complaint of plaintiff and default of defendant. Harold Cline appeared for plaintiff. Court founs allegations of complaint to be true and ordered decree quieting title. Estate and guardianship of He-ber He-ber Lawrence Robinson. Matter came on for hearing on ninth annual an-nual account and report of guardian, guard-ian, Harold Cline appearing for petitioner. Account was approved. Estate and guardianship of Quentin William Gunn came on for hearing on eighth annual account ac-count of guardian and discharge of guardian, Harold Cline appearing appear-ing as counsel for petitioner. S. Taylor Farnsworth was sworn and testified. Account was approved and petition for discharge of guardian was continued to September Septem-ber 14. Matter of adoption of Tina Marie Ma-rie Roe, minor. Harold Cline represented rep-resented petitioners, Leon E. Paice and Alta A. Pace, who were sworn and testified and in open court signed agreement of adoption. Petition Pe-tition was granted. In the matter of the adoption of Laura Kay Banks and Steven Niel Banks, minors, Harold Cline appeared ap-peared as counsel for petitioners, Margaret Grace Lund and Howard ' Lund, who, signed in open com the agreement of adoption, and petition was granted. Adoption of Christie Susan Tom-linson, Tom-linson, a minor, John O. Christiansen Christian-sen appearing for petitioners, Howard How-ard R. Low' and Mona Low. Petitioners Peti-tioners signed agreement of adoption adop-tion in open court but matter was continued subject to further order of court. Visiting this week at the home of Mr. and Mrs. Morris Allman were Mrs. Allman's brother and family, Mr. and Mrs. Mac Leetham . of Reseda, Calif., and a niece, tHelen Dean Leetham of Boise. |
