Show dependent Judges L'H 1 rj How and why are judges of the Supreme Court and ler Federal courts made independent of the Executive? For centuries judges were controlled by kings. This s one reason for fighting the Revolutionary War. The ii : ilaration of Independence stated that the king "has ob-S ob-S jcted the adrninistration of justice, by refusing his as-t as-t to laws for establishing judiciary powers. He has made - Iges dependent on his will alone, for the tenure of their -ees, and the amount and payment of their salaries". 4 Article TTI of our Constitution corrects these faults. It es the Supreme Court and other Federal courts separ-.rom separ-.rom the and independent of the Executive and gives Fed-1S Fed-1S i judges a life term at salaries which may not be dimmed dimm-ed during their continuance in office. r Dr. A. Lawrence Lowell, president emeritus of Harvard diversity, in a recent statement summarized the effect of t!; p as follows: ' t "The third or judicial branch of our triple form of gov-" gov-" Iment has over a period of a century and a half justified il,) confidence placed in it. Charges of improper or corrupt induct in the Federal tribunals have been very rare. Scan-b Scan-b attached to the judicial ermine have been nearly un-" un-" pwn, and although appointments have been common, yet Mthe judges who takes his seat the sense of justice has ex-w ex-w lded any payment of political debts. This is due to the f turity of tenure, to the absence of any fear of interference Me two political branches of government, and this to the 1(:.pendence of spirit that maintains the traditions of im- ijrtial justice on the bench.
