Show BEFORE THE BOARD OF OIL, GAS, AND MINING DEPARTMENT OF NATURAL NATUR-AL RESOURCES In and for the STATE OF UTAH ORDER TO SHOW CAUSE No. ACT-019-004 IN THE MATTER OF THE APPROVAL OF THE NOTICE OF INTENT AND RECLAMATION RECLAMA-TION PLAN SUBMITTED BY WES-PAC ENERGY CORPORATION, COR-PORATION, THOMPSON COAL MINE, GRAND COUNTY, COUN-TY, UTAH. THE STATE OF UTAH TO ALL OPERATORS, TAKERS OF PRODUCTION, MINERAL AND ROYALTY OWNERS, AND PARTICULARLY ALL PERSONS INTERESTED IN TOWNSHIP 20 SOUTH, RANGE 20 EAST, SLBM, GRAND COUNTY, UTAH. Notice is hereby given that tentative approval was given by the Utah Division of Oil, Gas, and Mining, to Wes-Pac Energy Corporation, Box 32, Thompson, Utah 84540, to commence underground coal mining, utilizing conventional underground mining methods, on portions of Section 29, Township 20 South, Range 20 East, SLBM, Grand County, Utah. The name of the mine is the Thompson Coal Mine, and the person representing the company in this matter is Mr. Homer Davis, Mine Supervisor, Super-visor, Box 65, Green River, Utah. Wes-Pac Energy Corporation Corpora-tion has fulfilled, obligations under the Mined Land Reclamation Rec-lamation Act of 1975 (Section 40-8, U.C.A., 1953, as amended) amend-ed) and will employ the following reclamation techniques tech-niques on 6 acres of fee owned lands: During Operations: 1) Mining will be carried out utilizing all safety measures called for by law and with consideration for the local environmental conditions. 2) Topsoil or upper horizon material will be preserved when new disturbance takes place. 3( Berms will be maintained adjacent to a dry wash contiguous to the operation to prevent surface pad runoff from entering the stream drainage. 4) A coal storage pile and a waste rock storage pile will be located in designated areas in accordance with all applicable MESA specifications. 5) Waste rock containing carbonaceous material or coal will not be utilized for berm or fill material. 6) Coal cleaning, i.e., washing or air jig, will not be conducted on the land affected. affect-ed. After Operations: 1) All portals, vent holes, and other openings will be sealed to prevent unauthorized entry. 2) All drill, core, and other exploratory holes will be plugged to prevent fluid or gas migration and will be surface plugged to prevent hazards. 3) General site and working pads will be regraded to slopes no greater than 35 degrees from horizontal. 4) Access roads will be closed and treated to prevent erosion. 5) To the extent available, topsoil or other upper horizon materials will be spread over the land affected. 6) The entire area affected will be revegetated using a specified seed mixture. 7) Mulching, scarification, and fertilizing will be employed employ-ed as needed for establishment establish-ment of a self-sustaining vegetal cover on the land affected. Reclamation performance surety will be established upon final approval of the reclamation reclama-tion plan. Any person or agency aggrieved by this tentative decision is hereby requested to submit written protest within 30 days of April 22, 1977, to the Division of Oil, Gas, and Mining, 1588 West North Temple, Salt Lake City, Utah 84116, setting forth factual reasons for his complaint, and thereafter, at a time and place horotobe established, appear before the Board of Oil, Gas. and Mining, to show cause, it any there bo, why this plan should not be approved.
