Show District Court Session Held Here on Tuesday Seventh Judicial District Dis-trict Court was in session ses-sion Tuesday for the regular reg-ular law and motion day. Judge Edward Sheya presided. pre-sided. The State of Utah vs. Jack V. Cagle came up for trial setting. The defendant de-fendant is charged with passing and uttering a forged instrument. The county attorney advised the court that shortly after the complaint was filed, the defendant made and the victim accepted restitution on the check, and requested that the trial setting be continued to the next law and motion. mo-tion. Judge Sheya agreed to setting the trial on said date and admonished that the County Attorney should make it clear to those who sign complaints .for fraudulent or forged checks that the purpose of criminal complaints is to deter criminal conduct con-duct and not to collect the amount of the checks for those who have been defrauded. The remedy for collection of checks is by civil action.. "If the courts are to deter this type of conduct," complaints once they are filed, should be prosecuted pros-ecuted until the case is finally concluded by a verdict of the jury or judgement of the court." The court emphasized that it did not constitute any punishment to simply allow the defendant to make restitution after commiting the crime of forgery or issuing a fraudulent check. The next criminal matter mat-ter to come before the court was State of Utah versus Charles Zeiler. The defendant was arraigned ar-raigned on a charge of carnal knowledge. Defendant De-fendant and his counsel were both present at the arraignment. After the reading of the Information, Informa-tion, the defendant entered en-tered a plea of innocent and trial was set before a jurv to begin March 27, 1973 at 10 a.m. The defendant de-fendant was released on his own recognizance upon motion of the County Attorney. The State of Utah, by and through the Trade Commission, versus City Market. Inc., was scheduled sched-uled for pre-trial before ' the court. Counsel for the respective parties advised ad-vised Judge Sheya that they were conferring together to-gether with a view of proposing a settlement of the case to the court and requested that they be permitted to have until the next law and motion day for this purpose. Judge Sheya granted the motion. The following divorces were granted: Sue P. Cooke was granted a divorce div-orce from Charles H. Cooke; William Charles Gallaway obtained a decree de-cree from Lanee Doreen Gallaway; and Linda Lo-vato Lo-vato obtained a divorce from Robert P. Lovato. The court also heard numerous probate, civil, and guardianship matters and set several matters for trial. |
