Show mm o;;ce AGAIN IN CUSTODY OF L0CAL POLICE No Charge as Yet Filed, Though Officials Say They Have Good Case. C. S. Cunningham is in jail again. Cunningham was released from jail last night, but was picked np by Detectives Wilson and Oolding at 10:43 o'clock this morning and was placed in the city iail without any charge against him being be-ing posted on the police blotter. ('unningham'a arrest following ao closely upon the heels of his release last night csme as a surprise to him. and he could not understand the vagaries va-garies of the law ia Utah. Cunningham was arrested a few days ago in connection' with the theft of nearly $4000 worth of diamonds aad other jewelry from the check stand at Haltair beach on August 7. He waa arrested ar-rested by Detective Captain Bilev M. Berkstead, after the latter had announced an-nounced that he bad enough evidence to secure the conviction of Cunningham on the charge of stealing the diamoads of two women friends of short acquaintance, acquaint-ance, whom he accompanied to the local pleasure resort. Cunningham waa released last night on an order from Justice Harry 8. Harper, Har-per, issued under- instruct ions irom the office of the county attorney. A bond of S10O0 was sriv'en hv Cunninffhsm. but as no complaint had been filed against him, some attorneys are of the opinion that the exaction of a bond was illegal, and that the surety waa not worth the paper upoa which) it was written. Captain Beekstead said laat night that he had explained the nature of his evidence against Cunningham to'N. U. 8. C. Jensen, assistant county attorney, and that this official had expressed hia willingness to issue a complaint. Deputy County Attorney Jensen signed an order yesterday afternoon. Instructing Justice Harper to approve a bond for 1K)0 presented by Cunningham, Cun-ningham, and the latter did so, erdor-aig erdor-aig Cunningham 'a release on this bond.
