Ia the trial of the case it was held that the marks on the sheep constituted prima facie evidence of the ownership, and the supreme eonrt holds thst this was not ia accordance with law. The judgment of the third district eonrt was reversed tg thg ease of H. f. Rugg, respondent, against D. H. Tol-aii, Tol-aii, appellant. Rugg began suit against Tolnrna for damages alleged to have bees done him by Tolman, who garnisheed his salary. Leer it was found that it, wee the wrong Rugg, whereupon the damage suit waa begun. ' Tha lower eonrt gave Rugg K54.rtn damages. The supreme court holds that Rugg eould only collect .actual dare-ages, dare-ages, and not exemplary damages. The exemplary damages amounted to i0Q. |
