District Attorney E. O. Leatherwopd thia morning introduced aa witneaaea Harry W. Oreer and Mra Mary Ada Oreer, brother in law and aia ter-in law of Daley. Brennaa'a body waa exhumed agaia yeaterday aad Mr. and Mra. Greer testified this morning that it waa not the body of Daley. By their testimony the state showed that Daley 'a height waa about Ave feet and six inches and John R. Young, an undertaker un-dertaker at O'Donnell'a, was called in rebuttal tn show that the height of the body of Breaaan was aot lets than Ave feet and nine inrbee. ' Armstrong waa recalled by the defense de-fense Tuesday morning, after which la lies Whitemso waa called. With the examination of Whitemaa the defense rested, la addition to those mentioned heretofore. Captain of Detectives R. M. Beekstead. A. T. Hpiers, Patrolman- G. A. Patterson, George Cole and A. H Thiessen were called for the atate in rebuttal today. The argument for the atate was opened by Assistant District Attorney P. T. Farnsworth. The case probably will go to the jury this afternoon. Armstrong waa the principal witness yesterday afternoon. He gave hia version ver-sion of the shooting which resulted in the death of Brennan. He declared -that Brennan had fired first and that ha only shot in self defense. |
