The supreme su-preme court of the District of Columbia on its own ' initiative today instituted proceedings ' fox . alleged ' contempt against President Samuel Oompers, Vice President Job Mitchell and Secretary Freak Morrison of the American Federation Feder-ation of Labor. .. The sentences of imprisonment im-prisonment imposed on these men by the court were, yesterday revoked by the supreme court, of : the , United States and the ease remanded to the district supreme eeurt. : Mr. Oompers, when told of, the action of the district court, said: Iiabor Men Sot Eannrng Away. ' The supreme court of the United States, ia - setting asids the sentences Of imprisonment, held that the case on which the lower court had acted constituted consti-tuted a civil contempt against the Buck Stove and Range company and that the offenses were punishable only by a Jnej te be recovered by the wronged, cor-'peration, cor-'peration, -' ' -Jnsriee Tmsr la handing down the called ' atteatiea to the 'fact, however, that 'if the lower court felt aggrieved it -could have . brought criminal crim-inal contempt proceedings in the premises prem-ises and have inflicted a jail sentence. The opinion, in conclusion, read:. Supreme Court's Conclusion. 1 "The judgment of jhe court of appeals ap-peals and ths supreme court of the District of Columbia are revoked and the ease remanded with direction that the contempt proceedings instituted by the Buck Stove snd Hangs company be dismissed, but without prejudice so the power and right of the supreme court of the District of Columbia to punish by a proper proceeding contempt, if any, committed against it." The lower eourt has been quick to take advantage of the opportunity afforded af-forded to reopen the ease. As the labor dispute wblch brought the esse into eourt hss been ended, it wss presumed the matter would be allowed to drop. Justice Wright of the district supreme court, who imposed the sentence on Messrs. Oompers, Mitebell snd Morrison, Morri-son, in instituting the proceedings answ today, appointed Joseph J. Darlington, Daniel Davenport and Jamee M. Beck, counsel for the Buck Stove aad Bange company, as a committee to inquire "forthwith" into the "question of whsther the labor leaders had violated the eoart s order.
