Bichaxds r - It Is asserted that Justices arbitrarily . rule - against, defendants in collection, ? suits' and - continually practice champerty cham-perty and' maintain suits for their . clients with their own money. ; One of the bills introduced by Bich- 1111 1 1 . , . y aris Is "an aet to punish champerty and maintenance -in Jastiee courts. " The bill makes it unlawful for any person but the party eoneerned 'to maintain a suit ia a Justice court. Tha aet declares that a person - who maintains main-tains such a suit or agrees to maintain sneh a suit shall be deemed guilty of a crime. The - penalty is fixed . at $25, eolleotible by the State through a civil actios, and also $25 attorney's fees and costs.- Another bill provides that certiorari shall be allowed ia all eases ia the Justice Jus-tice court where judgment is granted os an ex parte bearing or by default, at any time after judgment has been entered The District eonrt will be eailed upon to review all such cases. Hit Agencies Hard. The bill that hits the collection agencies the hardest is one relating to corporations. It declares that it is unlawful un-lawful for any corporation to make contracts of ehamoertv or maintenanea or to eagage inny business of soliciting solicit-ing or maintaining litigation ia aay of courts of the State. For violation of the act the penalty is the forfeiture of all franchises and charter and also subjected sub-jected to a fine of $1000. Another bill declares that any eity having a City Justice of the Peaee mar- prescribe by ordinance his salary ana that all fees from his office shall be paid to the City Treasurer. For School Libraries. Representative Richards has a bill prepared which will also be presented-today, presented-today, which provides that a certain amount shall be held out of the taxes in each school district for the maintenance main-tenance of libraries. The money is- to be expended under tha direction of the school board. Another measure instrodneed by Richards this afternoon, makes the County Attorney the attorney for the Javenile courts. It is an additional section known -as No. 9, whieh describes de-scribes the duties of the County Attorney Attor-ney and his relation to the Juvenile courts. |
