Show SMITH TO HAVE HIS HEARING WEDNESDAY Silas Smith, under arrest on a charge of murder In the first degree for the killing of Private Albert Hassett at Fort Douglas Christmas Eve, was arraigned ar-raigned before Police Judge Diehl Tuesday Tues-day morning and entered a plea of not guilty. Smith was represented by Attorney James M. Hamilton, who called the attention at-tention of the court to the fact that the Coroner's Jury that recently considered consid-ered the case, found a verdict that the killing wa justifiable homicide. Attorney At-torney Hamilton said there had never been a case before this where a man had been so shamefully abused and so viciously assaulted an Smith had been before the shooting. He asked1 that if it were possible, that the court fix a bond for Smith. This the court was unable to do, as the crime charged was of such a nature that bail could not be fixed. Three demurrers that had formerly been presented, were overruled by the court and the preliminary hearing was set for Wednesday morning at 10 o'clock. |
