Show NEW FIGHT STARTED TO SAVE BOTHA'S LIFE Judge M. M. Warner of Provo yesterday yes-terday afternoon filed a petition for a rehearing in the Supreme court In the case of the State against Charles Botha. The first appeal asking for a new trial was denied several weeks ago. Both the appeal and the petition for a rehearing are based upon the ground that the lower court erred in admitting certain evidence claimed to be prejudicial prejudi-cial to the interests of the defendant. This evidence was given by a witness named Rose, who testified that he had heard Mrs. Botha say that her husband had killed two men in Germany and that she was afraid of him. This is held to have been hearsay evidence, and 1 therefore not admissible. |
