Show RELEASED; REARRESTED Mrs. Douglas Free on a Technicality, but New Complaint Is Made. Mrs. M. I. Douglas, who was recently held to the District court for trial on a charge of assault with a deadly weapon, for the shooting of Mrs. Lottie Martin last December, was discharged on a technicality technical-ity by Judge Armstrong this morning and was immediately rearrested on another charge preferred by Mrs. Martin. The court held that Mrs. Douglas could not be tried for a. graver crime than she was charged with at the preliminary hearing hear-ing In the lower court. The court ordered that the Information be quashed. When she was arrested Mrs. Douglas was charged with an assault with a deadly dead-ly weapon, with Intent to do bodily harm. When the case was taken to the District Dis-trict court, an Information was filed by the District Attorney charging her with assault with intent to kill. Judge Armstrong Arm-strong held that the District Attorney had no right to charge the defendant with a greater crime than she was held to trial for. The information was accordingly quashed, on motion of Attorney lngebrel-sen. lngebrel-sen. representing the defendant. The District Dis-trict Attorney admitted that he had exceeded ex-ceeded his authority in Issuing the information infor-mation as it was issued. As soon a Mrs. Douglas was freed by the court, Mrs. Lottie Martin, at whom Mrs. Douglas fired half a dozen shots in the rooming-house on West Temple street conducted by Mrs. Martin. December 12. 1904. swore-to a new complaint charging Mrs. Douglas with assault with a deadly weapon, with intent to commit murder. Mrs. Douglas was immediately rearrested rearrest-ed as she was leaving the' courtroom, and her bond was fixed at 1750. The women met in the courtroom, but there was no scene. Mrs. Douglas claimed at the time she was arrested that she tried to shoot Mrs. Martin because the latter had alienated the affections of her husband. Mrs. Martin was wounded in the shoulder. |
