The order waa denied y Judge Beatty. tlJ10 affidavit It la 8et forth that the j 'American Smelters Securities com-I com-I pany owns the majority of the common . ; toclc of the Federal company and thereby controls the management of the Federal; that it owns all the stock .t the Taeoma smelter and Selby com-pany; com-pany; that since March It has induced ! the Bunker Hill company to enter into '; contract' to ship all its ores for twenty-! twenty-! five years to the Tacoma smelter at Ta- coma at an agreed price, the contract , requiring the Bunker illl company to operate its property at all times and to . ship to the smelter as nearly as possible possi-ble in equal amounts each month. Continuing, the affidavit says: "That complainant, the Federal Mining and Smelting company, has been paying dividends upon its large capital stock, and, affiant is informed and believes, has recently' been paying dividends in ticcss of what raid company is earning earn-ing from the operation of its said -' mines; that affiant la informed and be-, be-, lieves thia suit was broujht for the purpose of harassing this respondent and compelling it to sell its said mines at a price greatly below their real value, val-ue, so that the Federal company could pay dividends upon, its overcapitalized Btook. i , ...
