Show STATE TAX BOARD MARKS TIME ON LICENSES The state tax commission has begun consideration of the problem prob-lem of whether to appeal to the Supreme Court or await possible legislative remedy as the consequence conse-quence of a ruling yesterday by District Judge Herbert M. Schiller Schil-ler with respect to Utah's law governing gov-erning the right of the commission commis-sion to revoke driver's licenses. Roscoe E. Hammond, a member of the commission, whose duties include the driver licensing phase of commission activities, meanwhile mean-while issued a statement setting forth the state department position posi-tion with respect to Judge Schiller's Schil-ler's ruling. "We have not yet received a copy of the judge's decision," Mr. Hammond explained, "but reports indicate the jurist declared unconstitutional uncon-stitutional Utah's laws governing the right of the commission to revoke re-voke a driver's license in cases where the commission exercised .its opinion or discretion as to the 'habitual recklessness or negligence' negli-gence' of a driver. "This in no way affects the procedure of the commission in the revocation of chauffeur's or operators' licenses where revocation revoca-tion is mandatory under the law." |
