Show board of registration of electrical inspection shall make a report to the city council of Springville of its findings in said investigation. Any applicant dissatisfied with the findings by the board of registration regis-tration of electrical inspection may within ten days after said findings are rendered appeal to the city council of Springville. The board of registration of electrical inspection shall have power to issue the following certificates: cer-tificates: 1. Electrical Contractor's certificate to be issued to electrical contractors, which certificate shall entitle the holder to engage in electrical work described in this ordinance. May 6, 1940, entitled: "An Ordinance Relating to the Electric Light System Providing Pro-viding for the Creation of a Board of Registration of Electrical Inspection In-spection and for an Electrical Wiring Inspector Together with the- Duties and Powers of said Board and Inspector and for the Inspection, Maintenance, Care, Supervision and Control or Electrical Elec-trical Work and Installations in Springville and for the Licensing of Electricians and for the Issuing Issu-ing of Permits for Installation of Electrical Wiring, Fixtures, Appliances, Ap-pliances, or Apparatus, and to Provide a Penalty for the Violation Viola-tion of said Ordinance, or any Section Thereof, and Repealing Chapter 65 of the Revised Ordinances Ordin-ances of Springville, Utah, Passed Pass-ed by the City Council of Springville Spring-ville on the 1st day of April, 1931, Together with "all Ordinances Ordin-ances or Parts of Ordinances in Conflict or Inconsistent with this Ordinance." Every person per-son who shall wilfully or maliciously mali-ciously cut, break or throw down any of the poles used in "The Springville Electric Light System," Sys-tem," or who shall wilfully or maliciously cut, break or remove from its insulator any wires in use in said system, or shall by the attachment of a ground wire or any other contrivance wilfully destroy the insulation of said system sys-tem or any part thereof, or intercept inter-cept the transmission of the electric elec-tric current through the same; or shall in any other manner wilfully injure, molest or destroy any property pro-perty or materials appertaining to said system; or shall wilfully interfere in-terfere with the use of said system, sys-tem, or obstruct or postpone the transmission of the electric current cur-rent through the wires of said system, or procure or advise any such injury, interference or obstruction ob-struction to any line or wires of said system; the person so offending of-fending shall be deemed guilty of a misdemeanor, and upon conviction convic-tion thereof, shall be punished as provided in the next succeeding section. SECTION 2 3. Penalty. Any person per-son who shall fail, neglect or refuse re-fuse to comply with the provisions of this ordinance or who shall violate any of its provisions shall be deemed guilty of a misdemeanor, misde-meanor, and upon conviction thereof shall be punished by a fine of not less than J25.00 nor more than $299.00 for each offense, of-fense, and in default of payment thereof by imprisonment in .the city or county jail for not less than ten (10) days or more than six (6) months. SECTION 24. In the opinion of the city council it is necessary to the peace, health, and safety of the inhabitants of Springville that this ordinance become effective immediately. SECTION 25. Application for Permit. In order to secure a permit per-mit for the installation of electrical elec-trical wiring, fixtures, appliances or apparatus, and before any addition ad-dition to or alteration in any old installation of electrical wiring fixtures, appliances or apparatus is made, a written application shall be made to the city recorder on blanks provided for that purpose pur-pose by said city recorder, and the applicant therefor shall pay said city recorder in advance for said permit a fee of One ($1.00) Dollar provided, that no fee shall be charged where the entire cost of the electrical job is less than $5.00. SECTION 17. Rules Governing Installation, (a) Except as otherwise other-wise herein provided, all electrical wiring installations or electrical fixtures, apparatus, or appliances for furnishing light, heat, power, telegraph, telephone, district messenger mes-senger and other electrical work introduced into or placed in or on any building or structure in Springville shall be in conformity with the rules and requirements of the National Electrical Code, and all fittings and material used in such installations must be sanctioned sanc-tioned in the list of electrical fittings fit-tings published by the National Board of Fre Underwriters, which rules and requirements and lists are hereby made a part of this or- spection tag has been placed. SECTION 9. Certificate. Upon application for inspection of any wiring, apparatus, fixtures or appliances ap-pliances as ' hereinafter provided, the said inspector shall after inspection in-spection and examination, issue a certificate showing the result of such examination, and any correction correc-tion in said work necessary to be made. SECTION 10. Temporary Certificate. Certi-ficate. If said inspector shall be unable to inspect any electrical work within twenty-four hours after af-ter notice of its completion, a temporary permit may be issued by said inspector, allowing current to be turned on pending the inspection in-spection of such work. SECTION 11. Unlawful Installation. Installa-tion. If the said inspector shall find any part of any electric light or power wiring, appliances, apparatus ap-paratus or fixtures in or upon any building in Springville, to have been installed without permit or installed not in accordance with the provisions of this chapter or to be dangerous to life or property, pro-perty, "the inspector shall have the right and power to disconnect such defective work, fixtures, appliances ap-pliances or apparatus, and place a seal upon the same, and shall at the same time give written notice no-tice of such disconnection to the owner or occupant of the building. build-ing. At the time of application and for the annual renewal thereof the applicant shall pay the city treasurer of Springville for an electrical contractor's certificate a fee in the amount of $20.00. The fee shall be returned if the application appli-cation is denied. Each certificate shall be for the calendar year, shall expire at midnight on December 31st following fol-lowing the date of its issue and shall be renewed by the city council coun-cil upon application of the holder of the certificate and by his compliance com-pliance with all the provisions of this ordinance; provided that it shall not be necessary for the applicant ap-plicant for certificate to appear for examination before the board of registration of electrical inspection in-spection if his work theretofore has been satisfactory. Upon presentation to the board of registration of electrical inspection inspec-tion of charges in writing that the holder of any certificate has violated vio-lated any provisions of this ordinance, ordin-ance, or any ordinance of Springville Spring-ville regulating electrical installation, installa-tion, and permits of the use of electricity or is incompetent or unfit to comply with such provisions, pro-visions, the board of registration of electrical inspection shall investigate inves-tigate such charges and if, in its opinion the same are sustained shall make recommendations to the city council of Springville for the revocation of such certificate. The holder of the certificate shall be notified in writing by the city council that such recommendation recommenda-tion has been made and that unless un-less he can show good and sufficient suffi-cient cause to the city council why the certificate should not be revoked, re-voked, then the city council may revoke the same. This notification shall be delivered to the holder of the certificate at least five days in advance of his hearing by the city council of Springville. When TURES. OR-DINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF SPRINGVILLE, SPRING-VILLE, UTAH: SECTION 1. Electric Light System. Sys-tem. Control of. Name. The Electric Elec-tric Light System of Springville shall be under the exclusive control con-trol of the city. The Electric Light Plants constructed in Hobble Hob-ble Creek Canyon and Spring Creek, to supply Springville and its inhabitants with electrical power, pow-er, and all lines and apparatus for the distribution of the same shall be known and designated as "The Springville Electric Light System," Sys-tem," and shall be the property of said city, and shall be under the sole and exclusive control of the mayor and council, who may from time to time direct the construction construc-tion of extensions, and such changes as the necessities of the city and its inhabitants may require. re-quire. SECTION 2. Electrician. The mayor, by and with the advice and consent of the city council, shall appoint a competent and suitable person to be Electrician, who shall hold his office during the lite of the council appointing him and until his successor shall be duly appointed and qualified. His salary shall be as fixed by ordinance. ordin-ance. SECTION 3. Electrician to Have Charge of Power Plants, Etc. The electrician shall, under the direction direc-tion of the mayor and city council, coun-cil, have charge of the power plants, distributing systems and all apparatus belonging to the system. dinance. (b) All wires hereafter installed install-ed for furnishing light, heat or power in any building in the fire district must bewired in conduit. (c) All wires hereafter installed in buildings .to be used.,.for public . or industrial purposes, such as churches, stores, halls, school buildings, garages, manufacturing establishments . and warehouses must be wired in conduit.. All apartment houses containing three or more apartments, must be wired in conduit. For the purpose of this section, conduit shall mean r igid metal conduit, electrical metallic tubing, or approved metal moulding. SECTION 18. Notice. Inspection. Upon the completion of the installation in-stallation of any electrical wiring, fixtures, appliances or apparatus in or on any building, it shall be the duty of the person doing the work to notify the city wiring inspector, in-spector, who shall at once inspect the same, and if approved, there shall be issued a certificate of proper inspection which shall contain con-tain the date of such inspection-and inspection-and an outline of the result. It shall be unlawful for any person to turn on or connect the current with such installation until such certificate shall be issued; and it shall also be unlawful to make any change, alteration or extension exten-sion in or to the installation of any building after inspection, without notifying the city wiring inspector, and securing a permit so to do. SECTION 19. Electrician or Wiring Inspector to Enter Premises, Prem-ises, Rend Meter, Ktc. SECTION 12. Use of Disconnected Disconnect-ed Wiring Prohibited. It shall "be unlawful for any person to use any current in, through, or by means of such disconnected wiring, appliances, ap-pliances, apparatus, or fixtures, or to attach other wires for the supply of current to such disconnected discon-nected wiring, fixtures, appliances or apparatus, or to remove, break, or deface any seal so placed. SECTION 13. Permits. No person per-son shall install, maintain, alter, repair, extend or re-construct any electrical work, electrical wiring, devices, fixtures, appliances or equipment, either inside or outside out-side of any building, and no alterations alter-ations or additions shall be made in existing wiring, nor shall any wiring be installed or done for the placing of any lights, power or heating devices, or any apparatus which generates, transmits, transforms trans-forms or utilizes any electricity, nor shall any alterations be made in any wiring system after final inspection, without first notifying the Electrical Wiring Inspector and securing a permit therefor; except minor repair work such as repairing flush and snap switches, replacing fuses, changing lamp sockets and receptacles, taping bare joints and repairing drop cords, and all work done in or on the property of Springville or a public utility company, and wiring for appliances and devices operating operat-ing at less than 25 volts, for which work a permit shall not be required. requir-ed. Permits shall be issued to no one except holders of electrical contractor's certificates, electrical maintenance certificates or their bona fide employees and to individuals indi-viduals for work to be done on their own premises by themselves. Electrical Wiring Inspector. Duties. The electrician shall perform the duties of Electrical Elec-trical wiring inspector. It shall be the duty of the Electrical Wiring Inspector to inspect and supervise the construction, installation and repairs of all electric light and power wiring, fixtures, appliances and apparatus in or running to any building or structure in Springville, except as hereinafter provided; to inspect all electric light and power wiring, fixtures, appliances, and apparatus heretofore hereto-fore installed, and to require the correction of any defects therin which are dangerous or likely to cause fire and said inspector must require the correction of such defects de-fects as are actually hazardous to life or property. SECTION 4. Duties of Electrician. Electri-cian. The electrician shall perform per-form such duties as are or may hereafter be imposed upon him by ordinance, order or resolution of the city council, and attend to the enforcement of this ordinance and inspect and supervise the construction con-struction and installation and repairs re-pairs of all electric light or power wiring, fixtures, appliances or apparatus, ap-paratus, in, upon or running to any building in Springville and require that they conform to the provisions of the National Electrical Elec-trical Code except as herein provided. pro-vided. Wiring, fixtures and apparatus ap-paratus heretofore installed need not necessarily be made to conform con-form strictly to all the provisions of said code, but the electrician shall require the correction of such defects as he deems actually dangerous to life or property. SECTION 5. Application to be Made. Sign Agreement. All persons per-sons desiring to obtain power or light from Springville, shall make written application for the same to the city recorder and sign an agreement that he will be governed govern-ed by the terms of this ordinance and all rules and regulations that may hereafter be prescribed by 'he city council. SECTION 6. Board of Registration Registra-tion of Electrical Inspection. Du-ics. Du-ics. SECTION 20. No Liability of City. Springville Municipal Corporation Cor-poration shall not be liable for damages for any interruption of the service. Nothing in this ordinance ordin-ance shall be construed to relieve or lessen the responsibility of any person owning, operating or installing in-stalling any electrical wires, fixtures, fix-tures, appliances, apparatus, construction con-struction or equipment for damages dam-ages to any one injured or damaged dam-aged either in person or property by any defect therein; nor shall the said city or any agent thereof be held as assuming any liability by reason of the inspection authorized au-thorized herein or the certificate of inspection issued by the city wiring inspector. SECTION 21. Continued Offenses. Of-fenses. Every day's continuation of a violation of any of the provisions pro-visions of this ordinance shall be deemed to be a separate and distinct dis-tinct offense. i SECTION 22. Misdemeanor to j all electrical permits where work has been started before the proper permit has been issued. No permit shall be issued to any applicant for a permit during the time that he shall fail to correct cor-rect any defective electrical work after he has been duly notified to correct such defective work by the Electrical Wiring Inspector. SECTION 14. Contracting Electricians. Elec-tricians. It shall be unlawful for any person to engage in, commence, com-mence, conduct or carry on the business of a contracting electrician electri-cian without first obtaining a license li-cense so to do. A contracting electrician elec-trician shall be defined as any person who Installs any electrical wiring, fixtures, apparatus, or appliances ap-pliances for furnishing light, heat, or power, telegraph, telephone, district messenger or other electrical elec-trical work for a stipulated amount or under contract. SECTION 15. Each application for a permit to install electric wiring wir-ing must have attached thereto a sketch or blue print, showing in detail the proposed method of in- SECTION 8. Inspection. Inspection shall, when necessary, be made two or more times during the progress of installation, first, when work Is roughed in, and last when work is completed; and it shall be the duty of said Inspector to indicate inspection of any work by a tag or label attached to the service switch wires, and a certificate certifi-cate issued to the person taking out the permit. Such tag or label shall state the date and whether first or final inspection has been made.
