Show DRIVER ARRAIGNED IN COURT AFTER FATAL ACCIDENT Orson David Rust of this city, driver of the truck which figured in the death of Gail Averett and the serious injury of Le Grande Barker Sunday morning, was arraigned ar-raigned in Provo city court Tuesday Tues-day on a charge of involuntary manslaughter. Hearing of the case was set for Wednesday morning and Rust was released at the recommendation of the county attorney, on his personal per-sonal recognizance. The charges were filed by the county attorney, Arnold C. Roy-lance, Roy-lance, and Emer Terry, deputy attorney at-torney of Provo after they had consulted with Sheriff Theron S. Hall and H. W. Weight, Springville Spring-ville police chief. Mr. Weight reported that the Rust machine was traveling east on Center street and the boys were on the proper side of the highway, walking east and facing the approaching traffic. The truck angled across the street to the north side, ran off the paving and struck the two youths, he said. The county attorney who was investigating the possibility that Rust may have fallen asleep while driving, declared that the truck's right wheels were three feet off the paved portion on the left side of the highway when the accident occurred. David Rust told officers offi-cers that he did not know what happened. |
