Both principal of and interest on this bond are payable in lawful money of the United States of America at The Springville Banking Com-pany, Springville City, Utah. This bond is one of an issue of 450 bonds of like date, tenor and effect except as to maturity and option of redemption (and interest rate) is-sued for the purpose of paying part of the cost of constructing a City Hall and public building to house police and fire department facilities and furn-ishing the same for the benefit and use of the City of Springville and the citizens thereof, said building to be owned and controlled by said City, under and by virtue of and in full conformity with the Consti-tution and Laws of the State of Utah, and an ord-inance duly adopted by the City Council of said city on December 2, 1963, after having been duly authorized at an election legally held in said city Said taxes when collected shall be applied solely for the purpose of the payment of said interest on and principal of said bonds, respectively, and for no other purpose whatsoever until the indebtedness so con-tracted under this ordinance, principal and interest, shall have been fully paid, satisfied and discharged, but nothing herein contained shall be so construed as to prevent said city from applying any other funds that may be in the city treasury and available for that purpose to the payment of said interest and principal as the same respectively mature, and the levy or levies herein provided for may thereupon to that extent be diminished. The sums herein pro-vided for to meet the interest on said bonds and to discharge the principal thereof when due, are here-by appropriated for that purpose. Principal and interest falling due at any time when there are on hand from the proceeds of the above tax levy in-sufficient funds, shall be advanced from other funds of the city available for such purpose and such other funds shall be reimbursed when the tax levy pro-ceeds become available. Section 5. That the sale of said bonds to Con-tinental Bank and Trust Company and Associates of Salt Lake City, Utah, at the price of par and ORDINANCE NUMBER 88 AN ORDINANCE providing for the issuance and confirming the sale of $450,000 Public Build-ing Bonds of Springville City, Utah County, Utah. WHEREAS at a special bond election duly and lawfully called and held in Springville City, Utah County, Utah, on July 16, 1963, the following pro-position was submitted to a vote of the qualified electors of said city who had paid a property tax in the year preceding said election: Shall negotiable coupon general obligation bonds of Springville City, Utah, in the sum of $450,000, bearing interest at a rate not to exceed five per cent (5) per annum and due and payable not later than of the bonds be is-sued twenty (20) years after, the date and sold for the purpose of paying part of the cost of constructing a City Hall and public building to house police and fire department facilities and fur-nishing the same for the benefit and use of the City of Springville and the citizens thereof, said building to be owned and controlled by said City? WHEREAS the result of said election was de-clared by the City Council of said city, sitting as a Board of Canvassers, by resolution duly passed on July 22, 1963, from which it appears that the total number of votes cast at said election in favor of the issuance of said bonds was 999, and that the total number of votes cast at said election against the issuance of said bonds was 450; and WHEREAS the bonds authorized at said elec-tion have been this day offered for sale upon sealed! bids and, when said bids were opened, it was found that the bid of Continental Bank and Trust Com-pany and Associates of Salt Lake City, Utah, was the highest and best bid submitted; and accrued interest to the date of delivery plus a prem-ium of None, in accordance with the terms of the bid submitted by said purchaser on this date, is hereby in all respects ratified and confirmed. Said bonds shall be delivered to the purchaser as soon as they may be legally issued, upon receipt by the City Treasurer of the agreed purchase price there-for. Section 6. That all ordinances and resolutions or parts thereof in conflict herewith be and the same are to the extent of such conflict hereby re-pealed, and after said bonds are issued, this ordin-ance shall be and remain irrepealable until said bonds and the interest thereon shall have been fully paid, satisfied and discharged as herein provided. Section 7. That it being necessary for the im-- on July 16, 1963. The City Council of Springville City agrees that it will annually levy a tax sufficient to pay the interest on this bond as it falls due and also to con-stitute a sinking fund sufficient to pay the principal when due. Bonds of the issue of which this bond is one maturing after January 1, 1979, are callable for re-demption in inverse numerical order on that date and on any interest payment date thereafter at par and accrued interest. Notice of the call of any of the bonds for redemption shall be given not less than 30 days prior to the redemption date through the publication of an appropriate notice one time in a financial newspaper published in the City of New York, New York, and sent by registered mail to the place of payment of the bonds. It is hereby certified, recited and declared that all conditions, acts and things essential to the validity of this bond and the issue of which it forms a part do exist, have happened, and have been done, and that every requirement of law affecting the issue thereof has been duly complied with, and that this bond is within every debt and other limit prescribed by the Constitution and Laws of the State of Utah, and that the full faith and credit of Springville City are hereby irrevocably pledged to the punctual pay-ment of the principal of and interest on this bond according to its terms. mediate preservation of the peace, health and safe-ty of Springville City and the inhabitants thereof that the proceeds of the bonds herein authorized be available immediately for the purpose herein set forth, and emergency is hereby declared, and this ordinance shall be in full force and effect immed-iately upon its adoption and publication. That each of said bonds shall beJ signed by the Mayor and countersigned by the City Recorder, with the seal of said city affixed, and the said coupons shall bear the facsimile signatures of said officers. The Mayor is hereby empowered and directed to sign, and the City Recorder to counter--' sign and affix the seal of the city to each of said bonds and the acts of said Mayor and City Recorder in so doing are and shall be the act and deed of Springville City, Utah. All of the covenants, state-ments, representations and agreements contained in said bonds and coupons, and all of the recitals and representations of this ordinance are hereby consid-ered and understood, and it is hereby ordered and declared that said covenants and promises therein are the covenants and promises of Springville City, and that the representations and statements therein are the representations of said city. Section 4. That to pay the interest falling due on said bonds as the same becomes due, and also to provide a sinking fund for the payment of the prin-- l cipal of said bonds at maturity, there shall be and is hereby levied on all taxable property in said city, in addition to all other taxes, a direct annual tax sufficient to pay the interest on said bonds and to pay and retire the same as hereinbefore provided.
