PUBLI-CATION. BE IT ORDAINED BY THE CITY COUNCIL COUN-CIL OF SPRINGVILLE, UTAH: SECTION 1. Finding of Jurisdiction to Create Special Improvement District. The City Council of Springville finds and declares that, pursuant to the order of the Council duly made at a regular meeting of said Council held July 3, 1961, and in pursuance of the provisions of Section 10-7-41, Utah Code Annotated, 1953, there was duly published pub-lished for a period of twenty days in each issue of the Springville Herald, a newspaper published in Springville, Utah, beginning on July 30, 1961, and ending on August 10, 1961, a "Notice of Intention" of said Council to create a special improvement district, dis-trict, and of the further intention of the Council to levy special taxes as provided in Article 7, Chapter Chap-ter 7, Title 10, Utah Code Annotated, 1953, on the real property lying within said district for the benefit bene-fit of which said special taxes are to be expended in making said improvements. A copy of said "Notice "Not-ice of Intention" as published, together with the publisher's affidavit proving said publication, have been filed with the City Recorder of the City of Springville and are hereby referred to and made a part hereof. The said notice duly stated the purpose- for which said taxes are to be levied, the boundaries of said Sidewalk District No. 9 and in a general way described the improvements proposed pro-posed to be made with the estimated cost as de- to the direction of the Council and in the time ! manner required by law. Such notice specified spec-ified that protests or objections to such improvements improve-ments must be filed with the Springville City Recorder Re-corder on or before the 18th day of August, 1961. At the next regular meeting of the Council, duly held on August 21, 1961, the council determined that no protests had been filed within the time so limited and no persons appeared to protest against the creation of said district and the construction of the improvements therein and the levy of the special taxes to defray the cost thereof. The Council now finds, determines and declares that it has jurisdiction jurisdic-tion to proceed and to order the making of such improvements as provided by law. SECTION 2. District Created Boundaries and Improvements. Pursuant to the jurisdiction acquired, ac-quired, as hereinbefore set out, there is hereby created within the corporate limits of the City of Springville, Utah, for the purpose of constructino-sidewalk constructino-sidewalk as described in the said "Notice of Inten tion," to which reference is hereby made, a special improvement district to be known as Springville Citv Sidewalk District No. 9. The boundary lines of said district are described as follows, to-wit: Beginning at a point in the north line of Center Street, Springville, Utah, which pomt is 3036.59 feet East and 6.27 feet improvements to the entire depth backer v. streets, not exceeding, however, 165 feet, special improvement district taxes so assess? be used to defray the cost of such impi0V; 4 SECTION 7. Emergency Clause.
