On t h way to the Harris ranch at night. Kearney Kear-ney said, lights were seen at the ranch, and Kugene Harris remarked that it v.a:-a v.a:-a signal to him. He then stopped 'tin-car 'tin-car and answered the signal, after which the party proceeded to the Harris honu' Kearney said there were twelve sliotfi in Cone's breast and 150 in his back. ICugene Harris showed him where he stood - hen he fired the. shots that killed Cone and also showed where Leland Harris stood when he shot Deputy Dep-uty Sheriff Sahey. W. O. .Sutherland, a member of tli same party, said he asked Kugene Harris wiiy he shot Cone. The boy. ho said, did not say why lie fired the first shot, but said he ' fired the second shot because be-cause he thought Cone was trying to get to his gun and he was afraid Cone would shoot Mrs. Harris. Sutherland testified further that Leland Harris showed him where he stood when he shot Sabey. G. I "Wes&'el!. also a member of the party, testified that Eugene Harris told him at Gold Hill that he killed Cone and attempted to justify himself. F. F. Falkenhurg, another member of the party, testified that Eugene Harris told him that he killed Cone because Cone's cattle had given them much trouble and tor the further reason that Cone had struck him on the Sunday preceding pre-ceding the killing. Falkenburg testified further that while he was at the ranch and the boys were questioned with regard re-gard to the shooting. Mrs. Harris would Interfere to prevent them from talking. |
