Pratt against t he l"iah Liht & I Traction company. The reversal is de-I de-I creed on the sri'oun 1 that in his instruc-I instruc-I tions to the jury Judse Harold R. Steph-j Steph-j ens did not present to t li e jurors the theory on which the evidence of the company was introduced. ; Mr. Pratt was given a verdict for th amount named on account of injuries winch he claimed to have received, tnrough no fault of his, as he attempted to board a car of the company. The de-ff'nse de-ff'nse of the company was that Mr. Pratt attempted to hoard the car white it was in motion, contrary to the ruU:s of the street railroad. The case is ordered to new trial. |
