Show THE LAW S DELAl The supreme court of "Sew York has denied the application of Charles Becker for a new trial and t begins to look as if the police official convicted of instigating the murder of Gambler Ko sentbal would pav the extreme penaltv in the electric cha r During h s tr al and even after his conviction there was considerable svmpathv for Becker and some doubt as to his guilt on ac count of the character of the principal witnesses against him The sympathy and doubt are both lacking at present former supporters of the condemned man merely expressing regret that the informers go betweens and men who turned state s evidence to save them seh es cannot be placed in the electr c chair along with the associate they be traved The case of Leo Al Frank convicted of the murder of little Mary Phagan at Atlanta Ga s again being argued n the supreme court of the Lnited States and there seems to be some chance that the ruling of the Georgia federal court will be reversed and the case sent back for the taking of evi dence on the allegations of coercion and prejudice on which the petition for a writ in the court of last resort was based If the ruling is adverse noth ing can save Frank from execution unless the state authorities intervene in his behalf 1 Another celebrated case wh ch was to have come up for trial last Monday that of Harrv K Thaw on a charge of conspiracy n connect on with his es cape from the Matteawan asylum has been postponed for one week on account of the absence of one of the attomejs for the defense Ever s nco Thaw shot Stanford Wh te n the Mad son Square roof garden some six years ago the Thaw trials have been well n gh con t nuous and hundreds of thousands of dollars have been expended in an effort to set him at liberty There has been no end to the legal questions ra sed and it is certain if he is convicted of con spiracy another legal battle will follow As a matter of fact it takes a long time for just ee to triumph n the Un ted States if there is money and influence beh nd the man! charged with crime The axiom that it is better that ninety nine guilty men escape pun shment than ono innocent man suffer has been followed to such an extent that the hundredth gu lty man often eseares It is h gh t mo some of the loopholes in the crim nal laws were stopped up and the scales of Justice more evenly balanced |
