Show GIVEN FIVE DAYS TO ENLARGE OPENINGS CARSON CITY, Nov., April 27. United States District Judge Farring-ton Farring-ton rendered a decision today in the suit brought by the government against the Golconda Cattle company, charging charg-ing the illegal fencing of federal lands. In the court's opinion, no intention on the part of the Golconda company to violate the statutes was shown and no fines wcro imposed; but it was held that certain of tho company's fences, whilo enclosing Its own lands, did not admit of sufficient access to the public domain, and the defendant compnny was given five days in which to enlarge en-large the openings. "The defendant eompanv had the right to fence its own lands," said Judge Farrlngton. "hut it must not so exercise this right as to prevent public pub-lic use of government lands. I find no evidence of any intention to violate tho statute; but while the defendants have endeavored to keep within tbe law, I am satisfied that the openings are not sufficient to afford reasonable access to the land in question. Thoso to the west and south are insufficient. I herefore find thp enclosure to be unlawful and it must be abated. The defendants are given five days to en large the openings at To jam and Rock crock and at Willow creek." Congressman Kent of California is a member of the Golconda company. |
