Motion to quash the writ of prohibition issued from tho district court last Saturday Sat-urday against .lustico JTarrv S. Uarpor at tho instance i of B. P. Grant, chief of police, po-lice, was filed In court yesterday by counsel for Harpor. It is based on allegations thai the affidavit af-fidavit accompanying the writ states no facta to Justify the issuance of the writ, does not show that tho relator, the chief of police, is entitled to any relief as fought, and the furthcrr contention that the district court has no jurisdiction over the subject matter of any acts of tho justice of the pence. Accompanying the motion to quash is a demurrer, in which it is alleged lhat the chief of pollco did not act In good faith In applying for the writ and is only trying to hinder and hamper tho contempt con-tempt proceedings against him. The chief of police wa3 arrested last week charged with contempt of tho Justice's Jus-tice's court. He obtained a writ from Jude M. L. Ritchie, staying proceedings against himself. This writ is returnable September 27, when tho question as to whether the order, for ignoring which the chief was arrested, is valid, will be taken up. |
