Show MOOTED QUESTION IS SETTLED B MARSHALL Who Must Bear Costs and Pay Witnesses in Cases Before Master in Chancery. Judgo John Marshall of tho federal court. Monday settled the cmostlon of costs and witness fees In cases coming before the master In chancery. It was decided by the federal Judge, upon recommendation rec-ommendation of Master in Chancery J. W. Christy, that witness fees should be borne by tho parties to the action who subpoenaed tho witnesses. Heretofore tho witness fees havo been divided between be-tween tho contesting parties. Tho ruling rul-ing was made following an application by Special Assistant to the Attorney-General Attorney-General F. A. Maynard, in tho caso of tho United States versus Truth A. Milne Mil-ne r. Judge Marshall Issued an order Monday Mon-day remanding to tho state court the case of Varsalaki Znrva vs. the Gibson Asphaltum company, which had been transferred to the federal court. The case of tho Utah Building and Manufacturing company, bankrupt, was set for trial February li. Julia C. Blair, an Involuntary bankrupt, bank-rupt, was ordered to appear in tho federal fed-eral court and show causo why sho shall not bo punished for contempt of court for not having filed a schedulo of her assets and liabilities, It is said that tho accused ac-cused woman declined and refused to lllo such a schedule. She will bo held to answer before Judgo Marshall. |
