Smith, nnd Cox was set at liberty Upon tho conclusion of tho preliminary hearing, Tuesday, Justlco Smith took tho capo, as well as tho motion for dlsmlssAl, under advisement, ad-visement, and announced that ho would rendor his decision ot 10 o'clock Wednesday morning. Upon the calling of tho case at that tlmo, Justlco Smith decided that the State had failed to sustain Its allegation that Cox attempted to persuado Mrs. Anna Ferguson to remain away from Salt Lake In order that sho might not bo compelled to testify In tho caso of Dr. E S. Payne, who is accused of causing tho death of Miss Allco Ferguson by performing perform-ing a criminal operation. |
