and John MacGInnls against A S Bigelow W J Ladd and J S Bigelow stockholders stock-holders owning a majority oC the Boston Bos-ton Montana stock and Kidder Peabody Co The bill alleged conspiracy con-spiracy bv the defendants to despoil the interests of the minority stockholders stock-holders of Montana as represented by MacGinnis and Forester The bill states that Kidder Peabody Pea-body Co and Bigelow Lath have entered into unlawful agreement to acquire all the Montana stock und exchange ex-change It for Amalgamated stock one 10 four The bill also alleged that the deal Is contrary to public policy forbidden by common and statute law that the value val-ue of the Boston Montana stock will be dissipated and forfeited to the State A 1 temporary injunction pending a hearing and a permanent injunction stopping the combination was asked for Judge Knowlton granted an order of notice returnable June llth The defendants de-fendants agree not to transfer the Montana stock in their
