RICES ESTATE An Appeal Taken From Order to Pile an Assignment in Court New York April Surrogate Fitzgerald Fitz-gerald some days ago Issued an order directing Cantwell Moore attorneys for Patrick to file with the Surrogate the alleged assignment dated February Febru-ary 17 1900 by Rice to Patrick of the formers estate also the assignment oC September 21 1900 of the stock on deposit de-posit with Wall street bankers and letters let-ters of Instructions which Patrick is said tohave received from Mr Rice TodayCantweH Moore filed a notice of 1 appeal The hearing on this application appli-cation may not be heard for two or S three months i B B Rice a nephew and Capt Baker Ba-ker representing other heirs offered a moilon today to Instruct John P OBrien temporary administrator of the Rice estate to advance 250000 for the purpose of rebuilding the oil plant in I Houston Texas destroyed by fire about two weeks before Mr Rices death Patrick filed objections today through Cantwell Moore slating that the proposition is hazardous and speculative specula-tive and that If granted the estate would sustain a serious and Irreparable Irrepar-able loss
