any-thing being said concerning suspicions actions which Golden had referred to LEARNED OF ASSASSINATION At LaGrangc thc party heard that Goebel had been assassinated arid that the shot had been fired from the second or third story of the executive building The witness continued I said it was shame and an outrage and that It would blight the chances of all of us whose ofllces were In content I expressed ex-pressed similar sentiments to other people peo-ple that day DENIES STATEMENT OF GOLDEN Witness said that the statement of Golden that he spoke derisively when told of the shooting was absolutely false I thought It my duty he eon tlnued to return to Frankfort as soon as possible and did so that aftern JonI Jon-I went to the executive building and with my key the only one 1 ever had to the ofllcc unlocked the door i found the lock had been battered and had dllllculty In withdrawing the key I did not take the lock off and Hupplant It with a new one as has been staled J 13 Mathews put on the new lock NEVER HEARD VIOLENCE AOVO CATED j The witness said he never heard any j sort violence talked In the many conferences con-ferences In which lie participated except ex-cept In one held In the Commissioner of Agricultures ofllce In which Sheriff Burton of Brecklnrldge county talked In an Incendiary manner and was reproved re-proved by witness BEGAN AN INVESTIGATION The day after the assassination witness wit-ness said he began an Investigation to I learn where the shot was fired from I made no statement to Golden that I was satisfied the shots came from my ofllce and did not tell him I was thinking think-ing of going to tho commonwealths attorney I at-torney to tell him all I knew I did have a talk with Got Bradley about going to sec Franklin but ho advised against It and I did not go I WHAT HIS ATTORNEY ADVISED Powers said his attorney Judge Most advised him to go to the mountains and remain there until public excitement died out before giving himself up for trial The Legislature had appropriated appro-priated 100000 for the prosecution of persons charged with the crime and I did not believe was possible for men to get a fair trial In Franklin county Moreover I did not believe the civil authorities there would protect me I did not know that I could get a change of venue and these were the reasons which suggested Might from Frankfort HAD NO TALK WITH GOLDEN The witness denied that he had ever had any one of a halfdozen or more conversations with Wharton Golden about which the latter had told on the stand last week and denied that he had ever talked with him or anybody else about the killing of Goebel or any other oth-er member of the Legislature DENIED STATEMENTS OF WITNESSES WIT-NESSES In regard to the testimony of Robert Noakes witness said he never had a conversation with Noakes In regard to the smokelesspowder cartridges and never saw Noakes at Frankfort January Janu-ary 26th when Noakes alleged that the witness made so many damaging statements to him The witness was kept busy denying statements made by tho witnesses Noakes Golden Culton and Anderson AS TO GUNS IN HIS OFFICE In regard to the guns In his olllce which McKenzie Todd Gov Taylors private secretary referred to in his testimony the witness did not know how they came there but understood that one or two of them were left thereat there-at the end of Gov Bradleys administration adminis-tration The others were put In there later he supposed by mountaineers ADMITS A CONVERSATION The witness admitted part oln conversation con-versation between him and Representative Representa-tive Hampton of Knox county but said Mr Hampton had misconstrued the main point What ho said was that If Goebel should become Governor and witness held on to the ofllce or Secre tary of State that somebody might assassinate as-sassinate him but he did not mean to Insinuate that Goebel would have that done He also admitted that while in jail at Frankfort he urged Culton not to testify In the application for bail but said that he made that recommendation recom-mendation for Cultons own good and not because he knew anything that would Injure witness MISS SNUFFERS EVIDENCE He denied that he had made certain L statements to Miss Susie Snuffer of WHIIumsburg1 or that he offered bet any Inducement to leave the State and not testify against him I did say to her the witness said that I w w surprised sur-prised to see here here us she had l not been summoned She said they told her she had to come and that she did I not have money enough to Jeaw I the t State I did offer to loan her somo money and she might have used this PS she saw tit I did not recall basing hnd such a conversation with her us she claimed but I did not want her to testify against nc and J had rather now that
