Show I ANOTHER TIMBER CASE I Evidence and Arguments in Suit Against Price Trading Company The case of the United States vs the I Price Trading company and A Balling er for cutting timber on Government lands occupied almost tho entire day before Judge Rlner In the Federal court yesterday and is not yet completed As many of the main facts In the case had been agreed upon by counsel it was thought the case would occupy only a short time but several points were brought out the discussion of which took up the better part of the I day When court adjourned the arguments argu-ments on both sides had been completed com-pleted and the jury excused until tomorrow to-morrow when Instruction will be given giv-en and the matter placed in their hands The case is one of the several cases for alleged Illegal timber cutting that have been pending in the United States I court for some time This particular case Is one for cutting cedar posts on Government lands Capt Stl Ser special spe-cial agent of the General Land offlco located the timber which was later seized by l Deputy Marshal Smyth In all 9023 posts are Involved Of these 7000 were sold lo the Rio Grande Western West-ern railway for use In building fences along the line V An effort was made to prove that the V land on which the posts were cut the section lying north of Price was non mineral land and the testimony Introduced Intro-duced was along this line The issue In part hinges on tho question as to whether coal lands come within the description de-scription of mineral lands under the United States statutes The court held that the 7000 posts sold to the railroad company were not to be included In the charge against the defendants as those posts were used In the construction of new railway lines and came within the scope of the charter granted the company com-pany by the Government The charge to tho jury will In nil probability be to fix the amount of damage for the 20LG posts which arc admitted to have been V cut on Government lands and not to havo been uacd In the construction of the railway |
