Show MINING LESSEE CHARGES FRAUD I P T Farnsworth and D H Schcnck Accused by P W Ober of Conspiracy to Defraud Him PW Ober yesterday filed suit In the I Third District court against P T i FjtrnsWorth D H Schcnck and the Dalton Lark Mining company to recover J5000 and for the reinstatement of a certain lease In the complaint It Is alleged that on December 13th last the plaintiff for a Valuable consideration considera-tion leased for a period of aix months 200 feet of the Lead mining claim at Bingham and that In the lease was a clause to the effect that In case there should be a sale of the property at any limo during the period for which the lease was given the lease was to become be-come voU and the plaintiff should surrender the promises The plaintiff says he went to I work on the mine and and was extracting ore which netted him 2MO a day and that on January 12th the defendants conspired together to defraud him by falsely representing that the property had been sold to Farnsworth whereas It IH alleged no such sale was made and plaintiff believing be-lieving the representations made yielded up the property He asks that the lease be reinstated the premises restored to him and for 3000 damages |
