practically prac-tically till of yesterday afternoon in Judge Cherry court to tell a Jury how he had built a 1GOO set of teeth for Mrs A W MtCune It became necessary Ism I-sm for the doctor to explain the mattel mat-tel In a courtroom because A W Mc Cunc the ladys l husband refused to I pay the bill on the ground that the I amount charged was exorbitant In the complaint which was filed about a J year ago Dr Griswold alleged that the professional services were rendered between be-tween August 1 1 1S9S and January 1 180D that besides his own work ho had I paid out 200 for assistance and services ser-vices Incidental to supplying Mrs Mc Cune with a full act of teeth Uit ho had taken great pains with the teftth and that a reasonable remuneration wan 1000 For a second cause of action It was alleged that the plaintiff at the Instance and request of the defendant Alfred W McCune had endercd professional services to the defendants daughter Miss Fay McCune to the amount of SGS for which he also asked for judgment judg-ment I In the answer Mr McCune alleged that the services rendered to Mrs McCune were performed in so unskillful I ful a manner that the teeth were of no value to eltlnr the defendant or his wife And that If the work had been well and skillfully donO they would have been oilh 200 and no more In answer to the second cause of action ac-tion It was alleged that the work done for Miss McCune was not worth over 20 but that since the suit was filed the full amount of the demand 6S had been paid The plalntlfl was represented by Attorney At-torney C S Vnrlan and the defendant by Attorney E 33 Crltchlow I GIVEN CARTE BLANCHE Dr Griswold was called to the stand and In reply to questions J by Mr Ya miami he itstifled that he had been emI em-I ployed by Mr McCune to furnish his wife with a full set of firstclass teeth that nothing had been said about the price but that ho had been given carte blanche and Instructed to furnish the llncst and most natural bet of teeth that could l be made Where did the conversation occur 1 when Mr McCuno gave you the order for the teeth At my olhce I had been doing some work for him and he then wild that his wife had had a good deal of sickness juid that the teeth she had did not lither lit-her Tho d old teeth he said rattled rat-tled so that he wouldnt sit at the table with her and he arfkcd me It I cduldnt do anything to remedy It I told him I could inn Ice her a new set that would be all right and ho wanted the best that could be had The doctor then told hpw Mrs Mc Cune had gone to his ofllce many times how he had made models of the ladys mouth and sent them to George N Schwartz a famous dentist in Chicago to make plates from TO RESTORE ORIGINAL EXPRESSION EXPRES-SION The witness went Into detail showing the pains he had taken In making the models and fitting the teeth to the plates fn such a way that the gel ral effect on the face of the patient would be to restore the identical expression she had before she lost her natural teeth He calculated and measured to a nicety distances and relative sizes of the lips chin nose and forehead He studied Mrs McCuncs expression for weeks and also that of Mlsu McCune the latter study being to ascertain as near as possible from the daughters face the exact expression which the mother had when she was a young girl He look most of the measurements from a photograph furnished by Mrs McCune taken before she lost her natural teeth Here the witness PIO duce a drawing of MM Modules face front view which had been made on the basis of the measurements and tho witness said it was a very well balanced bal-anced face AMUSED MRS MCUNE AND I DAUGHTERS When the picture was produced Mrs McCune and the three Misses McCune who were all In court laughed hearL1l rat r-at It S ItMr Mr Crltchlow objected to the picture being shown to the jury That caricature cari-cature he declared has nothing to do with the case i Mr Varlan Its not a caricature and not Intended as such The purpose of It Is merely to show the Jury how the doctor did the work The court allowed It to be used and In addition to the picture a blackboard was called into requisition on which the witness drew his Illustrations I MADE HER LOOK YOUNG You took a great deal of pains with the teeth asked counsel Yes indeed I did and I thought I had been very successful when Mrs McCunc told me after she got them and was wearing them that an old friend had told her she looked more like she did when a girl than she had I done for many years 1 thought then I had done a good piece of work In restoring I re-storing the ladys original expression I The teeth then restored the face to I Its former natural appearance S Yes there wore however some wrinkles about the sides of the none I and checks but I told 1 her they could ho removed by massjigo and she employed em-ployed lhai means with very satisfac tory results The witness then went on to relate that Mrs McCune accepted and ore the teeth HP met her in April 1899 and she waa wearing them then She had complained that they I hurt her some but all new teeth are S uncomfortable at first he said lIe usked her to come up to his office In order that he might fix them If they needed anything but she said that as there was so much trouble about the bill she didnt care to MCUNE REFUSED TO PAY When did you first present the b1l17 On December 22nd to Mr McCuno at the streetcar office He said It was more than he expected but he would see abet It Where did you see him again 1 Ono day nl f the AHu club He again said he would sec In a day or two If the matter could not be arranged and 1 Paw him again at his Senatorial headquarters at the Kenyon hotel He got very angry that time and refused to pay it EXPECTED TO GO TO WASHINGTON WASHING-TON He acknowledged he had given me carte blancho and said he could afford I to pay the bill as well as anybody but he thought It wjiu too much Before I that he had told me he would be going to Washington soon and I then asked him to consult good dentists In the J iJst PB to what such work should cost and he ould find that my charge was moderate r Hid ho agree to that No he said there were as good ex perts In Salt Lake as anywhere lhat I had a gosvl reputation aw a filler of teeth hut that I didnt know much about Rome other departments of den tI HIY and that he had gone to the wrong man The witness was crossexamined by MI Crilchlow bu this testimony re mained unshaken Miss Minnie Walker who occupies a position In Dr Orlswolds office testi led that Mrs McCunc went to the office very frequently as a patientS Time witness also testified that Mr McCunc gave the order for the teeth In her piescnco at Dr Grlswolds office thai McCune told the doctor that the teeth his wife then had rallied BO that he wouldnt sit at the table wilh her lie told Dr Griswold to make the best set of teeth possible Nothing was said 1 about the cost Depositions by W J Younger a noted Chicago dentist were read going to show that Dr Griswold had done good work and that the priccwas mod crate Court then ajourned until this morn ing I |
