Tbe supreme su-preme court yestorday rendered a decision de-cision in the case of Editor J. A. Mo-Knight Mo-Knight of the Journal for publishing in a gossiping article the words of "an old Moutanian" to the effect that the Davis will contestants could not get an impartial trial before any judge or jury in Butte, where the vast estate lies and from which it would be removed if the contest is successful. Tbe supreme court held that contempt con-tempt of court is confined almost exclusively ex-clusively to acts that interrupt the progress pro-gress of the business of the court. "We are passing upon a question of law as botween the rights of a citizen and the power of the court to summarily imprison im-prison upon a charge of the court. The power is given to the court to enforce obedience and respect to the authority of the court. It is not to enforce a sentimental sen-timental respect, for that must be gained by other means and will come ft a court where law and order is administered ad-ministered with able, fearless and impartial im-partial fidelity." The prisoner was ordered discharged. |
