The-City Council shall- also appoint a Superintendent of Water-worts, an Assessor of water rates, t and such other officers as may be necessary to carry on the works. All officers so appointed shall hold office during the pleasure of said Council. . Sko 2. The Superintendent of Water-works shall, under the directum direc-tum of the City Council, have charge of tha resorvoirs, water tanks, water mains, fire hydrants, and all the machinery ma-chinery and appurtenances appertaining apper-taining to the, Water -trorkov .He shall have the direction of the lavine of water mains, the putting in of service ser-vice pipe? ajid the regulation of the water supply to fire hydrants and to all consumer. , Said Water Superintendent, Superin-tendent, before entering upon the duties of his office, shall take an oath -of office and give bonds, with ap-proved ap-proved security, to Salt Lake city, in the penal sum of $5,000, conditioned for the faithful performance of his duties. He shall report to tho City Council quarterly, or oflener if required, re-quired, his doings as Superintendent the condition of the Water-works, and make such suggestions as the nature Qt the. service may require. ' Sec; 3. All ! 'hydrants shall be under the dontrot of, and shall be kept in repair Vj' the Superintendent of the Water-works, and in case o tire or fires tho Firo Department and such others as .the City Council shall authorize, shuH' have Iisjo- access to said hydruuts; No other person shall open or operate auy fire hydrant, or attempt to draw water theretroui. . Sec -1. Any .person who shall wil-fully wil-fully or- carelessly run a vehicle against a tire hydrant, or otherwise wilfully or carelessly injure the same, or draw or attempt to-jdraw water therefrom, shall, be subject to a fine of not exceeding one hundred dollars, and be liable for all damages done to aid hydrant. Sec 5. Wrenches foi firo hydrants shall be furnished by order of the City Council to the Fire Department, for their use, and to such other per- 1 boos as may be deemed proper by the Council, aud any officer or member oi the Fire Department, or other per- &toa having charge of one or more of said wrenches, who shall permit the same to be taken from, their place of deposit, or to be used for any other purposes than those authorized by the City Council, shall be liable to a fine of not exceeding fifty dollars lor each .'flense. -SfiJ-, 8. -"Whenever any person Vdasires to obtain a supply of -water from the City Water - works, he shall make application there- for, verbally or iu writing, to the Mayor and sign an agreement that he -will be governed by such rules and regulations not iQonoLatenl with Ibis "ordinance as may be prescribed fcfcy the nlayqr lor tho control of the '- water supply; said application must state the location, kind of .building, number of roome, and the entire area of grounds to be supplied, and fully and truly state the purposes for which the water is to be used; and upon notification from tho Mayor, the ( Superintendent - of- - Water -work, is authorized to extend, at the expense of the city, the aervico pipe to the inside in-side line of the curb stone.or tq within, sixteen fest of tho property line, at the' point moat convenient for supplying the premises ol the applicant, ; - J Sec. 7. When application is made by a tenant, it must bo accompanied by the signaturo of the owner of the building or grounds consenting to and authorizing the introduction of water into such .premises, and ex- fressly agreeing to the rules and regu-ations regu-ations embodied iu the application . and to liia provision. If any consumer shall waste any water, or. allow it to be wasted by negligence, such as imperfect imper-fect stop or valves or leaky joints or pipes, or allowing tanks to i leak or to overflow, or waBtefnlly run it through basins or other apparatus, or use tho water for purposes other , than stated in the application and license, or in violation of the rules and regulations for controling the water supply, and the provisions of this ordinance, the water may bo cut j oft from such consumer, and all pay menta forieitod, unless such person shall promptly pay- Buch additional charges aa may be imposed. Sec. 13. Whoever, by himself. 1 jlj family, servants or agents, shall use ' the water coming through the water mains without first obtaining a liccuso therefor, or shall without authority open any stopcock, valve or other fixture attached to the system of water supply, or Shair in anywise injure, detaoeor impair any part,-or any !' appurtenance of the "iVater-works, or shall cast anything into auy reservoir or tank of the said works, shall be fined not exceeding one hundred dollars dol-lars for each oflonae, or by imprisonment imprison-ment not exceeding six months, or hy ' both fine and imprisonment. Sec. 14. If any person, ufter the ' water has been 'turned oft from his premises, on account of non-payment of dues, or violation of the rules and regulations pertaining to the water supply, shall turn tho water on again, ' or use, or allow the water to be used without authority, ho shall be fined not exceeding fifty t dollars for each offense. l Sec. 15. Fountains and sprinklers for lawns, gardens, yards or sidi walks shall nut ho operated during n (ire. No fountain attachment .shall be greater than half an inch iu diam eler.-- There shall be a- stopcock to each fountain attachment, which shall be under tho control of the Superintendent. .. - Sec. 16. Sprinktcr.-t for lawns. g:n dens, yards and sidewalks must be used only for the purposes expressed in the license; and no sprinkler shall be used for sprinkling the streut out-, side of the sidewalk, unless such privilege is included hi the license and paid for accordingly. Sidewalks, windows and fronts Bhall not be sprinkled except between tho hours of 6 and 9 a.m., 1 and 12, and G and 8 p.m. No nozzle foreprinkting shall be larger t'jan one-fourth inch in diameter, and no license lor a sprinkler shall bo issued except iin connection with other water service. Sec. 17. Sprinkling wat;oiis and wagons for the delivery or sale of water must be filled from hydrants erected for that purpoao, and shall be regulated and controlled by the superintendent. super-intendent. Sec. 21 . The City Corporation shall not be held liable for damage to I auy consumer by reason of a stoppage I or interruption of his water supply, caused by scarcity of water, accidents to the works or mains, alterations, additions, repairs or other unavoidable unavoid-able cause, beyond a pro rata reduction reduc-tion on his license during Bupb stop pace. ; Szc. 22. No telegraph post, hitching hitch-ing or other post shall bo put down or set within four feet of any water service ser-vice pipe, nor within six feet of any main pipe, except on a written permit per-mit from the Superintendent.' Sec. 23. Wherever the water mains are laid, no person shall he allowed to convey the waters of City Creek from any ditch or plaee by private pipes for fountains, mcchani' cal or other purposes, except the ordinary irrigation of lots, under direction of the Watermaster, nor tihall eiiid waters be hereafter diverted from tiie ordinary irrigation ditches tor the supply ot .steam boilers or other mechanism, and all resolutions, ordinances and permits allowing any person to convey the waters of City Creek, or any part thereof from the ordinary ditches by pipes for any use or purpose whatever, wherever the water mains are laid, are hereby repealed, re-pealed, -'- . Sec. 24. It shall be Uhe' duly of the Assessor of water rates to ascertain ascer-tain by measurement, cr estimate, as near as practicable, the amount of water Uied by each water taker; and he shall make an equitable assessment assess-ment thereon, based upon the. rate of ten cents for each one thousand gallons; gal-lons; and no persona shall have the water conducted to their premises without paying five dollars per annum. an-num. If they consume more than the worth of five dollars they shall pay at the above mentioned rates. Said assessment shall be made for a teniixonimencinR from the time the watar is lurutd. on to the premises and ending on the 31st day ot March, 1S77, and thenceforth quarterly. Sec. 25. Any person violating any of tho provisions of this-ordinance, where tho penalty is not herein other wise provided, shall, on conviction, be liable to a fine not exceeding fifty dollars lor each offense. Seo. 26. -r-No thing herein contained shall prohibit the City Council Irom amending, alteiing or adding to the provisions of this ordinance in, relation rela-tion to the water supply or the rules and regulations which may be adopted adop-ted in conformity therewith; Provided, that no alteration in water rates shall apply to auy license issued or contract made with a consumer under thisor- tit nance, until after the expiration of such license or contract ' c.-.-.a 1 Sec. 27.
