Over a year ago Jack was committed to the district court on the charge of killing Ned Doyle, but the district court was aiming aim-ing at higher quarry and allowed Air. Biegan's case to pass first one term and then another, until finally a writ ; of habeas ooipus was sued out before tho probate court,and h. was released. Night ore last, one William Smith was wi g aLug the south side of Temple b i , one John Davis boing in that nti?ntorhood at the same time Three jfiividuals of tbe male persuasion attacked Air.- Smith ; one polite'y floored him.acd held him while another " went through him," the third standing by to see, probably, that nobody interiered ; and Smith came out of the matter poorer by $fJ0. Yesterday Yes-terday Mr. Davis identified Mr. Biegan as the party of the first part, who did the knocking down ; Mr. Charles Studer as tbe party of tho second part who did the "going through," and Air. James Dunn as the party of tho third part, who did the sentry business. Jack also assaulted Air. Davin, and commenced com-menced to add battery to tbo 'sault; and for the latter offense was fined $15. The former offense being more serious, the court held tho three in $3,000 each to appear for trial at tbe next regular term of tbe probate court. As the police- enter the occupation of each person arrested, we were a little ourious to know how those parties stood, and found them thus: "John : Biegan, thief and robber;" "Charles Studer, thief;" James Dunn, thief." It's a nice thing for a man to have his distinctive and characteristic profession so lucidly stated. |
