Show I GOVERNMENT RESTS Havemeyers Counsel Ask That Ee 3a Found Not Guilty Washington May 26The govern ment rested its case against Henry 0 Havemeyer the president of the American I Amer-ican Sugar Refining company shortly after the noon recess today Thereupon There-upon Mr Johnson of Philadelphia the j leading counsel for the defense moved that the judge instruct the jury to lird j I the defendant not guilty on six grounds First that the questions as to the local and state contributions of I the case were beyond the juriletion I of the senate committee and impertinent imperti-nent second that it was not the part i of Mr Havemeyers duty to axamini I records for the purpose of answernsr 1 the questions that he could not answer from memory third that when books or records are demanded that books tr I records are evidence fourth that the I question put to witness was too broad covering irrelevant matters fifth that if the witness were to be held recusant I I i was the duty of the committee to warn him that the question vas a com I nittee not an ImlivOual question and sixth that the Indictment did not disclose cause of action Mr Johnson made an argument of an hour and a half in sunoort of his motion mo-tion and when he concluded District Attorney Davis asked for an adjournment I adjourn-ment which was granted Mr Davis will reply to the motion tomorrow The concluding testimony of the government I govern-ment offered at the morning session I i was not Immediately important save for the purpose of making up the record I rec-ord as to what occurred in the senate investigating committee |
