Show A SlOE QITESTJOX 1 the Carrying of Lottery Tickets or Drawings Commerce WASHINGTON Nov 13Is carrying carry-ing of lottery tickets or drawings from one 5 state to another commerce within the meaning of the constitution is a question which the courts took under consideration this afternoon after argument ar-gument by Mr J D Goldsmith and Mr James C Carter of New York and Assistant Attorney General Whitney The case at bar was that of Robert L France and eight other voters of the United States of the United States district court for the southern district of Ohio They had been convicted of conspiracy to commit an offense against the United States by causing to be carried from Covington Ky to Cincinnati 0 a number of policy lottery lot-tery tickets and had been fined 1000 each with imprisonment added The daily transfer of tle poliqy slips over I the CincinnatiCovington bridge was the crime which the plaintiffs in error were charged with For the government it was maintained main-tained by Assistant Attorney Whitney that the carrying of slips in question was commerce within the meaning of the constitution and the decision of the courts and that the act involved therefore was valid and constitutional Mr Carter and associate counsel maintained that it was not commerce and that the law therefore was unconstitutional I un-constitutional There was a full bench of justices and they listened to the present lstened argument ment with interest The Santa Fe TOPEKA Nov 13It has been agreed by the attorneys for both the prosecution and defense in the Santa Fe receivership suit to try the case on its merits in the federal court Nov 23 Three points will be raised First the constitutionality of the alien land act a applied to railroads second the constitutionality of the law as applied to alien land owners in general third whether the act passed both branches of the Kansas legislatureS legislature-S Railway otex The Union Pacific has made an open round trip rate to Brigham of 235 This is for the benefit of duck hunters For the rabbit hunters a rate of 125 to Cedar Fort on Thanksgiving day Superintendent Bancroft and D E Burley left for Boise last night The Union Pacific Railway company has just issued a number of new illustrated illus-trated pamphlets of portions of the country through which their line passes The newest of the issue is entitled en-titled The Original Overland Route and contains a vast deal of information informa-tion of a very interesting character in regard to the history and achievements of the Union Pacific and of the most remarkable features of the country of which it was the pioneer Another is devoted to the states of Washington and Oregon and contains fascinating descriptive literature and remarkably fine views Another is called Sights and Scenes in Utah also illustrated and one is devoted entirely to the mining min-ing camp of Mercur They are all gotten up in beautiful style and the illustrations il-lustrations are superb |
