Show I UNION PACIFIC WILL DEFEXD SUiT Method of Procedure in the Land Cases I General Solicitor Kelly of the Union Pat Pa-t chic system has issued a circular in response re-sponse to many inquiries from persons I who had purchased properties along the line of the Union Pacific and who had recently been notified to appear before the I United States circuit court for the district of Nebraska Many hundreds of these persons have been alarmed for fear that I the titles to their homes were endangered by the land suits brought by the govern ment against the Union Pacific The circular I cir-cular declares that these fears are groundless and assures the purchasers and owners of such properties that the I railroad company will look after their interests j in-terests The circular is as follows I In the suits against the Union Pacific Railway company its receivers and sun dry other persons holding title to lands I under conveyances from the Union Pacific Pa-cific Railway company i is required that appearances be made in said court by attorney i at-torney on April 6 1S96 Answers must b I filed May 4 unless further time therefor is allowed either by stipulation with the I government solicitor or by an order of court I courthe I The receivers of the Union Pacific Rail way company and the railway company itself are defendants to this suit and have been served with process I am authorized to say that the Union Pacific Railway company and the receivers re-ceivers vill undertake the defense of the suits not only as to the interest of the Union Pacific Railway company but also for account of all or any of the defendants defend-ants therein Each defendant served with process is requested to send to W R II Kelly general solicitor for the receivers of the Union Pacific Railway company I a copy of subpoena delivered by the United I I Uni-ted States marshal stating postofllce ad j i dress and place of residence I I In case the interest of any defendant I i shall appear to require appearance by at torneys other than those employed for enployed I this purpose by the receivers and the company he will be notified so that he I may secure other counsel After citing the several in Afer sevel cases ques I tion the circular goes on to say The questions involved in cases are I now pending in the supreme court I is believed that the rule adopted by the circuit i cir-cuit court will be affirmed I this rule j I prevails those holders of Union Pacific i titles who are bona fide Pacfc i i bought relying upon the patents of the i United States will prevail in the present suits I will however be proper for them to file answers in apt time setting I up their bona fide holdings as a defense to the suit of the government |
