Show A J WlirnUASS CASE He Makes a Personal Plea For aNew a-New Trial SAN FRANCISCO Aug 2A J Whiteman exbanker and millionaire Of Duluth Minn mayor of Duluth momber of the Minnesota legislature and recently convicted of forgery made a personal address today in the superior court in support of his own motion for a new trial The new trial was demanded on the score of newly discovered evidence The charge against Whlteman was that he had victimized several friends in San Francisco by means of a forged check drawn by Frank Dixon upon a New York bank All through the trial Whiteman insisted that there was suoh a person as Dixon although le could not be found Now M is stated that Dixon has been found and has stated in the presence of certain reputable re-putable residents of Chicago that he had really signed the 500 check and had sent It to Whit l 1an in payment of an indebtedness Then Whiteman by permission of the court made an eloquent address reciting his social and political prominence r nd his efforts ef-forts to find Dixon He begged the court not ito put the brand of a feon upon a man who had not been legally I convicted of a crime Judge Wallace continued the further hearing of the motion for two weeks instructing the special counsel for the prosecution in the meantime to ascertain as-certain whether or not Whitemans story is true The count staled that if there is really such a person as Dixon and if he signed that check I and sent iL to the defendant White man would have a new trial |
