Show RELIEF FROM TAX SALES AN IMPORTANT RULING UY COUNTY ATTORNEY WIIITTEMORE Lnml Can Be Redeemed Without Additional Expense Couirty Court cOlt the Suggestion Ullla Ordered Or-dered Paid Justice and Con iivV > le For Hunter PrecinctOther BusineSS Busi-ness I II I I I County Attorney Whittemore filed an opinion with the county court at its meeting yesterday which will be read with a great deal of satisfaction by many of the citizens of Salt Lake city and county Mr TVhittemores opinion came as a result of l reference to him of the petition of Frank Thompson for the redemption of certain property sold by the collector to the probate judge because be-cause the taxes were not paid the time for the redemption of the fsame having expired In determlninggthis question the attorney takes the position posi-tion that its importance is of a grave character Not only is the county deeply Interested but the persons L whose property has been taken for taxes The whole machinery of a tax sale to the county says Mr Whitte more has for its only purpose the putting put-ting Of a certain sum of money into the treasury in respect to the land on which the sum is assessed as taxes The county does not desire this land The sales are made to It not for proat I but to prevent the loss of revenue The lands sold to the county for ta sales are sold again by it as soon as the time for redemption has passed and in most cases for the taxes costs and redemption of sale here can be no god reason advanced why lithe li-the owner agrees the county should not be at liberty to receive taxes interest in-terest and costs from owners without trouble and expense and why this should not ipso facto extinguish the statutory title after two years had elapsed as it would have extinguished It before or In other words why a certificate of payment should not be as good as Q deed Especially should this be so before the title to the property is conveyed to the court by a tax deed I The attorney says that the adoption of a rule to allow redemptions of property sold to the county for taxes In all cases where deeds have not passed to the county will result in great saving of costs to people who have been unfortunate enough to have their property sold for delinquent taxes and who have not redeems them within the twoyear limit by reason of inability to do bo or from want of knowledge as to such sales Under the custom now in rogue it 1 costs from nO to 20 to advertise and sell a piece of property to which the county has obtained a tax title This expense added to the original costs of the sole 6 is a grievous burden to the taxpayers Mr Whittemore advises that the petitioners pe-titioners in this case be allowed to redeem re-deem upon the payment of the origlna taxes and Interest and costs He also sugested that a list of all property now held by the county uncle sales for which deeds have tax Bes not been received be published for a period of ten days and that persons who now own such property subject to the rIght of the county be allowed to make redemptions by the payment ot taxes costs and Interests with in thirty days from the time the list is first published Mr TYhittemores opinion was adopted aJhd the list will be published That there will be many surprises Is i beyond question for dozens of pieces or property have been sold of which fact the owners are yet in Ignorance I Other business transacted by the county court is a follows Ben Hagrers bill of 9220 for work I performed and allowed on State road was approved On the claim of Kelly Co for 43740 for supplies furnished various county officers 300 allowed ofcer was al and 50 appropriated on account Twentyfour dollars was appropriated appropriat-ed H P Dwyer for Incandescent lights The bH of William W Merril justjve of the peace and acting coroner for an Inquest held on the body of the man found drowned in Jordan narrows I amounting t 2060 was ordered paid W L Davis of Alta filed his bond I as road supervisor in the sum of 500 with G Stewart and S Perry as sureties sure-ties which l was approved Treasurer Dukes bill for 115 for water used at the old court house property pro-perty accompanied by a notice to the effect that if it was not paid the aqua would be turned off created consternation nation The bill itemized is Lawn 2000 yards G 00 Family 5 00 Three baths 3 00 Seven closets 7 01 Court house 20 00 Jail 2O 00 The bill was referred to the jail committee com-mittee William Ridd who was elected justice juS-tice of the peace of Hunter precinct but did not control at the tim asked to be reappointed A A Jones constableelect of the same preclnc fileda similar request Both petition were granted Hans Highland Co were granted a license to sell liquor at BIngham next Court then adjourned u until Thufsda |
