| Show The Cortez Mining Company Suit I Special to THE HERALD Examiner Dispatch NEW YORK April 28Judge Wallace in the United States district court handed down a decision yesterday in the suit of 1 the Cortez Mining company against Tann haues2r il Co of San Francisco which was brought to prevent defendants from suing complainants to compel them to carry out their agreement to purchase tho mine known as the Cortez mine situated in Valley Val-ley Perdldo California The mine was owned by Dauriac Vermont Ernst of California They owed considerable money to Tannhaueser Co and offered the mine in payment of the debt Tannhaueser Co gave an option on the mine to HenryS Henry-S Brooks in 1879 and he arranged to sell it to Hatch Co of this city and a company was formed called the Cortez Mining company com-pany to work tho mine Its capital was 1500000 It was soon learned it is claimed the representations of tho value of the mine were false and the company refused to buy it and brought suit to prevent defendants from suing and forcing them to buy it The suit was decided in their favor |
