Show I DAVIS MURDER CASE II DEFENDANT FOUND GUILTY OF iNVOLUNTARY iN-VOLUNTARY MANSLAUGHTER i The Jnrors Were Out Until After 10 oclo lc Last NightTime For Sentence Not FIxert News Notes 1 Provo Sept 27 The jury in the Davis case after being out all night was brought into court and admonish ished about expressing an opinion or allowing al-lowing any one to approach them on the subject The foreman announced to the court that they were unable to agree on a verdict The court sent them to breakfast in charge of bailiffs and at 12 oclock noon the jury again announced that it was Impossible to agree They I were sent back with instructions to deliberate delib-erate a short time longer The jurors remained out until 1025 tonight to-night when they returned a verdict of guilty of voluntary manslaughter I The time for sentence was not fixed Fred C Kenber Olaf H Olsen and Christian Christiansen were admitted to citizenship 1 A jury was empaneled in the case of The People vs Andrew Nielsen AssIstant AssIst-ant United States Attorney Thurman prosecuted and Jacob Johnson defended The defendant is charged with driving stock from the range near Castle Dale Emery county on the 8th of January 1854 contrary to law The defendant was 1 found guilty of the charge by Justice Anderson of Castle Dale court and ap pealed to the district court The testimony testi-mony went to show that defendant drove some cattle not belonging to burn from the range in Castle Dale to a winter range 30 or 40 miles away The defense opened by putting the de fendant on the stand The defendant stated that he thought the cows in que tion belonged to some of the parties who he was driving for and did not intentionally intention-ally drive them off The jury brought in a verdict of acquittal ac-quittal The case of the United States vs H G White charged with adultery was taken up White lived in Springvlile and is a married man He is accused of committing com-mitting the crime with Ethel Rose of Bingham The trial is now in progress District Attorney Thurman on the opening of court at 2 p m stated to te court that the riot cases against Tuft et al would not be pushed to prosecution as he believed the men did not intend to violate any law were good men In the community and he would therefore ask that the Indictments against them be dismissed dis-missed The order was made dismissing the cases and exonerating their bondsmen bonds-men Arthur Brown is one of the most Disgruntled Dis-gruntled Republicans in Utah today Arthur is mad all over He denounces both factions of his party particularly all exliberals They have shown titer ingratitrde to Mr Brown by ignoring him in the convention in Salt Lake Ke says they have nominated a rank non Mormon one who went to Washington with a petition in his pocket to dtsfran chse every Mormon in Utah Arthur offered at the time to go to Washington to defeat it He says the Mormons have sanctioned the nomination of a man who has been and is their avowed enemy A prominent Republican from Salt Lake who is here attending court said on the streets today that Frank Cannon Was surely gone that he could not be elected Right you are Mr AttornT The Republicans here are having considerable consid-erable trouble among themselves At the primaries last night open fighting was quite common and today much bad feeling feel-ing ismanifest Men were run in aid nominated as candidates to the county convention who are not satisfactory to the majority of the Republicans and a number of them are expressing themselvr3 very forcibly against any such rrcceed inS One thing is certain and that 3 there is disruption In the ranks of the Provo Republicans |
