| Show HELD If OH ADULTERY I Uie Examination of Ed war cowther Yesterday Yester-day Morning I Edward Crowther recently of Coalvillo but now of this city was arrested yesterday morning morn-ing on the charge of unlawful cohabitation alleged al-leged to have been committed by living with Lydia Crowther and Ellen F HeJIeran as his wives The defendant was taken before Commissioner Com-missioner McKay for examination Before the proceeding commenced he exhibited to Mr Mc Kay who conducted the prosecution pardon t granted the defendant by President Cleveland S f t gn t i t 8i In 1885 upon recommendation of the Utah commission com-mission the judges of the supreme court and the 4 governor The examination then commenced and Ellen G Crowther was called and testillcd I am the defendants daughter My mother is Ellen G Crowther I have been Hiving with my mothers sister Mrs Snarr at Park city since April 1889 Fatner has had two wives one my mother and the other Lydia Crowther Father lives now with the latter who is his first wife During the past three years he has been at my mothers house a number of times Has not stayed there over night Mother has seven children the youngest about a year old It was born February 15 18S9 In May IbSS he came to our house about 2 oclock in the morning and remained in mothers room till morning He same at 2 or S a m on several occasions Mother aas not been married again I heard fairer sato > sa-to her that sho need not say who was tio fin of tho youngest child To the defendant the witness said You left me and two others in the theater one night togo to-go home alone I stayed at my aunts and when I got home next morning you were in bed In mothers room Mother was up and dressed when I got home That was In the summer of 1SSS When you got the pardon I told you that you had disowned me and the rest of us I clung to you until the last and that is what I got for it I never said I hated you though you have done enough to make me do so Tho defendant stated that he was not the father of the plural wifes youngest child and he wished to prove it Mr McKay asked him it he was willing to bring disgrace upon the woman in order to save himself and when he replied that he was Mr McKay said he would ask the court to hold him on the charge adultery instead unlawful co habitation Ellen E Hefferan was the next witness She testified I was married twenty years ago to Mr Crowther the defendant He had a wife then My youngest child was born February 15 1839 Mr Crowther its father Ho has not been at my house for several months He called one day since the baby was born He does nothing for my support He does not pretend to live with me After he was pardoned by the President he was at my house a number of times This was all tho testimony of anyjimportanco idduccd tim commissiondr held the defendant on the charge of adultery and Used his bonds at tzOOO At last accounts the defendant had not jucceeded in Jlnding sureties The Third District The following business was transacted in the third district court yesterday John Nickles vs Mammoth Mining company > y consent dismissed Howard vs A H Mayne default of defend I lot entered United States TS George B Leonard et aL two cases demurrer overruled and defendants illow ed ten days in which to answer George FuSIon was arraigned on the charge of burglary The crime was committed in this city Several months ago and since then tho defend int has been confined to the county jaiL In view Df this fact and that he only stole a pair of Shoes the defendant was allowed to plead guilty to the charge of petit larceny and was sentenced to two monthsDimprisonment the tounty jaiL T E Harper a petit juror was excused The case of John P Writburg vs Salt Lake City in which the plaintiff sued to recover apiece a-piece of property on the East bench was dismissed dis-missed because of the plaintiffs failure to maIm imendmcnts within the time allowed by the court I Geneva Cowan TS Robert Cowan default of defendant and decree of divorce on the grounds Bf desertion and failure to provide In the case of Clarence Garland charged with voluntary manslaughter David Hamer and Paul Hammer charged with unlawful cohabitation cohabita-tion and Henry Scumldt charged with fornication forni-cation the defendants were ordered to appear in court on Monday next to plead |
