| Show BEATTYS CHANCES A Question as t the Presidents Power to Appoint Him DDBOIS NAME PUT i THE ROLL Of Senators Was Done at dmnnds Instance stance Alturas and Logan Counties Idaho Without Officials Wlhout WASHINGTON D C March 6 Special telegram to THE HERALD Although there is no doubt that the President would like to reappoint Judge Beatty there is some question as to his power to do so The point has been made that as this Is a new office it can only be filled by and with the consent of the Senate and that the Presidents Presi-dents attempt so to fill it having failed he cannot appoint a man now and have him serve until the Senate can act on the nomination nomi-nation The question is under advisement ut the department of justice Until a decision de-cision is reached no intimation of the view of the department will be given out Solicitor General Taft said today Nine months would be a long time to wait but if the President has no right to fill the vacancy we will have to wait The other view is that a vacancy within the meaning of the law actually exists and that the President has the same right to fill it that he has to fill any vacancy While it looks simple to a layman yet it presents a legal aspect of delicacy and difficulty to the legal mind The Critic tonight prints the following u An important stop has been taken in the settlement of the contest over the seat of Senator Dubois of Idaho His name has been put on the roll of Senators General McCook secretary of the Senate hesitated about so doing saying he didnt want to take any chances but Senator Edmunds told the general that he did not think the secretary was taking any chances in so doing He held that it didnt make any difference what credentials Mr Claggett might have Mr Dubois was the undoubted Senator and his name should go on the roll Accordingly it was put there and there it will stay as the law and the precedents are in his favor Senator Dubois will go t the Bermudas in a few days to sniff the salt sea breezes and enjoy the balmy climate of those salubrious isles The AlturaaLojcan Counties Complication BELLEVUE Idaho March 6Special telegram tel-egram to TiE HERALD There is a pretty complication in Alturas and Logan counties do facto growing out of the LincolnAlta legislation The officers of Alturas and Logan are refusing to act because they are legislated out of office In the meantime the governor has not appointed their successors suc-cessors Practically we are in 0 state of anarchy and criminals can murder and bu n without fear of being arrested The doors to the county treasury are locked C S Doan treasurer of Logan county today refused to allow any money to come into the treasury and of course will not allow any to go out Civil suits commenced be fore justices are thrown out of court and the creditor is left whistling for his money while the debtor quietly steals away The old officers of Logan and Alturas counties coun-ties are presumably saying with Othello My occupation is gone and are making a grand rustle for signers for a petition asking the governor to appoint ap-point them over again The LincolnAlta bill had scarcely become a law until a Democratic official of Alturas county came to Bellevue praying the citizens to sign his petition asking a Republican governor to appoint him over again He was told to go home and he went Bellevue people wH book no petitions ot that kina They ignore the state Legislature the weak kneed governor gov-ernor and all and will rely upon the supreme courts of Idaho and the United States to protect them Justice as they see it may be expensive but they want it and seem disposed t have it at any cost |
