House The Council had a short and peaceful f session yesterday OldManAfraidof theCars was absent his friends having kept him awake long enough to attend the Liberal county convention where he found food to suit his tvrentyfiveyearold palate and ghoullike reveled in dead things The only important measure in the Council was the introduction by Lund of a memorial t Congress asking that the buildings and grounds of the Industrial homo bo turned into a territorial deaf mute institute for three years and thereafter to be perpetually the property of the school board of Salt Lake city The memorial is Very favorably thought of by members of both branches of the legislature who have been Been on the subject and it will doubtless doubt-less pass by a big majority vote I the House there is now pending another an-other bill which will be carefully watched L by physicians of all schools It was introduced intro-duced a few days ago and is as follows Section 1 That upon the passage of this aot the governor of this territory shall appoint annually three boards of medical examiners who shall hold once for one year or until their shall successors are appointed ahese boards shal be constituted a follows One board consisting of live members to be selected from seven fvo nominees presented by the Salt Lake Medical society One board consisting or live memoers to be selected from seven nominees presented by the Utah Homeopathic Medical association And one board consisting of five members to be selected from seven nominees presented by the Utah Territory Eclectic Medical society The Trrtory appointed shall go before a district dis-trict or county judge and make oath that they ere graduates of legally chartered medical colleges col-leges zre in good standing and that they will faithfully faith-fully perform the duties of their office All vacancies caused by remoral death resignation resigna-tion or otherwise shall be filled by appointment appoint-ment by the governor from nominations presented pre-sented by the society to which the member causing the vacancy belongs within one month from the time that the vacancy shall occur Sec 2 Each of said boards shah organize Immediately after the passage of this act by gslect ng from their members a president and secretary and treasurer Each board shall havo a seal and attest its official acts under seal The president of each board shall have authority to administer oaths and the board shall tako testimony in all matters relating to Its duties Each board shall have the power to Issue certificates t all who furnish satisfactory proof of having received degrees of licenses from chartered medical colleges in good and legal standing and pass a satisfactory examination exami-nation before said board Each board shall prepare two forms of certificates one for persons per-sons examined and favorably passed upon by the board the other for persons as provided for in sectisn te 1 of this act Each board shall furnish to the county recorder of the several counties 1 list of all persons residing in said county receiving certificates from the board Certificates shall be signed by all the members of the board granting them and shall indicate the medical rociety from which the board hast has-t > ecn appointed None of said boards shall entertain an application for examination which has been rejected by another ol said boards nor shall any rejected application be renewed until at least one year after the action of the board rejecting the same Sec 3 The fee for the examination and certificate cer-tificate as provided for in section 2 of this act shall be 535 which shall be paid Into the treasury treas-ury of the Medical society from which the board receiving 1 shall have been appointed And the expenses and compensation of the board shall subject to arrangement with the society See 4 Graduates of respectable medical colleges col-leges who are at this time engaged in actual practice in this territory shall he licensed to practice medicine under this act upon presentation presenta-tion of their degree to one of said boards and upon producing satisfactory evidence of the identity of said applicant The fee for such license shall be 55 to be paid Into the treasury of the medical society from which the board receiving re-ceiving it shall have been appointed The secretary sec-retary of the board shall enter without fee upon the register to be kept by hur the names of all persons to whom licenses arc issued as physicians and surgeons See 5 Every person holding a certificate from one of the board of medical examiners shall have it recorded in the office of the recorder re-corder of the county in which he resides within three months from its date and the date of record re-cord shall be endorsed thereon Until such certificate cer-tificate Is recorded as herein provided the holder thereof shall not exercise any of the privileges conferred herein to practice medicine medi-cine Any person removing to another county to practice medicine shall record the certificate in like manner in the county to which he removes re-moves and the holder of the certificate shall pay the recorder the usual fees for recording other papers See 6 The county recorder shall keep In a book provided for the purpose a complete list of the certificates recorded by him with the date of the issue of the certificate and tho name of the board granting such certificate I the certificate be based upon a degree and examination exami-nation he shall record the name of the medical college conferring the degree ana the date thereof The register of the county recorder shall ness hours be open t public inspection during busi Sec 7 Examinations shall be made wholly or partially In writing See 8 Each board of medical examiners may refuse to issue the certificates provided for in this act to Individuals guilty of unprofessional unpro-fessional or dishonorable conduct andit may revoke such certificates for like causes Sec 8 Any person shall be regarded as practicing medicine within the meaning of this act who shall treat operate upon or prescribe for any physical ailment of another or who shall hold him or herself out by means of signs cards advertisements or otherwise as a phy stolen and Burgeon but nothing in this act shall be construed to prohibit service In case of emergency or the administration of family remedies and this act shall not apply t commissioned com-missioned surgeons of the United States army in the discharge of their official duties or to Tislting physicians in actual consultation Sec 10 Any person practicing medicine or surgery within the territory without first hating hat-ing obtained a certificate as herein provided for or contrary t the provisions of this act shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than 450 nor more than 300 or by imprisonment In the county jai not less than ten days nor more than ninety days or bota fine and imprisonment for each and every subsequent offenseprovided that either party may appeal In the name time and manner as appeals may be taken in other oases except that when an appeal is prayed in behalf of the people no appeal bond shall be required Into the territorial All fines treasury so obtained shall be paid Sec 1 All persons graduates of medical colleges who have practiced medicine ten years continually In this territory prior t the taking yean effect of this act shall upon elect Uis shal proper application and payment of tho fee examination as provided pro-vided for in section three of this act accompanied accom-panied by a petition signed aot twenty live legal voters living la the city or precinct where such applicant practices be admitted to examination before any one of the bard of medical examiners and if satisfactory satisfac-tory shall receive such certificate unless It shall be ascertained and determined by the of medical examiners that board the person so apnlying for a certificate is of immoral character charac-ter or guilty of unprofessional or dishonorable conduct in which case said board may reject such application and provided that such applcation application ap-plication for a certificate shall be made ap six months after the taking effect of this act and all persons holding a certificate on account of ten shall be subject to years practice 8hal all the requirements and discipline of this act in regard re gard t their future conduct In the practice of medicine the same as all other persons holding certificates And all persons not ert al having applied ap-plied for or received such certificate within six months after tho taking effect of this nct and 1 persons whose applications have for cause herein named been rejected certificates re voKeo snail I tney practice medicine be deemed guilty of practicing medicine in violation viola-tion provided of law and shall suffer the penalties herein See 12 All persons practicing obstetrics in at this territory shall within three months after the passage of this act apply to one of the boards of examiners for a certificate and after passing a proper examination shall be entitled to the same upon paying into the treasury of the society from which the board was appointed ap-pointed the sum of 10 to be applied toward defraying the expenses of said board Any person practicing obstetrics within this territory 9 r without first obtaining the license herein provided for or contrary to the provisions of this act shall be deemed guilty of a misdemeanor misde-meanor and upon conviction shall be fined not less than J3 nor more than 8103 or by Imprison anent in the county jail for not leis tan five days or more than thirty days or both fine and imprisonment for each and every subsequent offense Provided That either party may appeal in the same time and manner as appeals may bo taken in other cases except that when an appeal prayed in behalf of the people no appeal bond shall be required All fines col lected under this act shall be paid into the territorial ter-ritorial treasury Provided That all persons who shall furnish to said board satisfactory af fidavits of having practiced obstetrics for five d years previous to the passage of this act shall freanljra s license without examination shal payment of the fee provided for in this section I Nothing in this section shall b construed to apply to physicians holding certificates in accordance ac-cordance with this act or to prohibit service incase in-case of an emergency Sec 13 It shall be the duty of the county attorney to prosecute all offenders under this act actSee See 1 Each board of medical examiners shall meet on the first Monday in January March June and September of eachyear at 10 oclock nm and such other times as the president presi-dent of the board shall deem necessary The place tal of meeting shall be at the territorial capi talSec Sec 15 Any member of either board may be removed from office for misconduct in office by a twothirds vote of all the members of the board but no member shall be removed until after he has been given a trial en-actment the United States shall grant to the territory of Utah the ground und building in Salt Lake city known as the Industrial Homo for the following purpose towit To keep tho same as a site for the accommodation accommo-dation of its school for deaf mutes for the period per-iod of not to exceed three years and thereafter perpetually hold the same for the use and benefit of the common school system of Salt Lake city Utah or to convey the same subject t the frs lute for three years to the board of education of Salt Lake city aforesaid as a par of the property of the common school system of said city And your memorialists represent That the I deaf mute school is now located in tile grounds of the University of Utah that the grounds and buildings of the latter are now inadequate and that on account of the incompatibility of the two institutons and the urgent need or al the grounds and buildings for the university it is necessary to at once remove the deaf mute school that the territory has no site or building build-ing to which the school can bp removed and it will take two or three years to provide a site and building That these institutions as well as the common com-mon school are wholly maintained by direct taxation That the benefits of the Industrial Home have heretofore been quite limited and hereafter it will be or little use for the purpose of which it was constructed and its usefulness would be greatly enlarged by devoting it to the purpose asked And your memorialists will ever pray By EvansAmending section 2S37 of the compiled laws which was referred received from the House stating that the governor had approved ap-proved H F No 20 disposing of persons charged with crime also that H F No 21 had been passed by the House Both of which were filed for jurors services in 1S75 which was referred to the committee on claims And then the Council adjourned The House All the Liberal members of the House save Pierce Colton and Marshall were absent ab-sent when the speakers gavel fell yesterday yester-day the duties for which they were elected being neglected in order that they might attend the funeral obsequies of the Liberal party in territorial convention assembled Pierce looked rather lonely in his corner while the minutes were being read and Marshall saturated himself with good Democratic doctrino from the columns of THE HERALD over which his dome of thought was just barely visible to the spectators and the legislators BEPULATING PHYSICIANS Marshall presented by request a petition peti-tion from Fred John ooncerning the bill to regulate physicians THE HOME RULE MEMORIAL The Council announced that it had passed C J No 2the Home Rule memorial and it was sent to the House for its action thereon All rules Interfering with the Utah CACHE COUNTY nODS Wright presented a petition from the county court of Cache county representing represent-ing that the county had several county roads connecting it with surrounding counties outside the populated part of the county that these roads need repairing and bridges that the funds of the county were exhausted and the petition asked an appropriation of 8000 for the purpose of doing this work Referred ADDITIONAL REPORT The governor submitted a communication communica-tion from James J ck exterritorial treasurer treas-urer as follows I learn from the published pub-lished re ports of Bolivar Robert esq territorial ter-ritorial treasurer that he has not included Jn his report to you the receipt and dis bursements made by myself as treasurer de facto from fact January 1 to March 15 1890 although at tho latter date I turned over to said Roberts all books and vouchers with the other property belonging to the treasurers office Allow me to hand you herewith a state ment of the receipts and disbursements from January 1 to March 15 1890 THE CONTAGIOUS SEASDIES BILL Nebekers bill to prevent contagious diseases among cattle and sheep came up on its third reading and was amended slightly Isebeker made a strong argument in favor of its passage as did also Pike and others Snow being the only negative vote when the yeas and nays were called The bill is as follows Section 1 That the governor of the territory terrtor i hereby authorized to nominate and with the advice and consent of the Council appoint without with-out unnecessary delay after the passage of this tlt a competent veterinary surgeon who shall be known as the Territorial Veterinarian anon an-on entering on his duties shall take un oath to well and truly perform his duties as provided prorm dutes by law Sec 2 The duties of said veterinarian shall be as follows To Investigate anyand all cases of contagious or Infectious diseases among do mestlo animals in this territory of which he may have knowledge or which may be brought to his notice by any resident in the locality where such disease exists And it shall aleo be his duty In the nbsencd of any specific Information to make visit of inspection to any locality where he may have reason to suspect that there is contagious or infectious disease and to inspect in-spect under the regulations ot this act all domestic act al mostic animals that may arrive at any railroad I station in this teritory when these animals aroJ such as to warrant the presumption that they are intended to remain i the territory and are toe > to-e or may be used breeding purposes herein And no animal pronounced unsound by the veterinarian vet-erinarian shall be turned loose removed or permitted to escape but shall be held subject to the order of the veterinarian Any person ailing to comply with this provision shall be deemed guilty of a misdemeanor and upon conviction con-viction shall be fined in any sum less than 5300 Sec 3 In all cases of contagious or infectious infect-Ious diseases among domestic animals in this territory the veterinarian shall have authority to order the quarantine of the infected premises and In case such disease shall become epidemic In any locality In this territory the veterinarian veterinar-ian shall immediately notify the governor of the territory who shall thereupon issue his proclamation forbidding any animal of the kind among which said epidemic exists to be transferred trans-ferred from said locality without a certificate from the vetetinarian showing such animal to be healthy See 4 In any case of epidemic disease where the premises have neon previously quarantined by the territorial veterinarian as before provided pro-vided ho is further authorized and empowered when in his judgment necessary to order the slaughter of any or of all diseased animals upon said premises and of all animals that have been exposed to contagion or infection under the following restrictions Said order shall be a written one and shall be made in duplicate du-plicate and there shall be a distinct order and duplicate for each owner of the animals condemned con-demned the original of each order to be filed by the veterinarian with the governor and the I du licate given to said owner And further before slaughtering any animal or animals that has been exposed only and does not show disease dis-ease the veterinarian shall call in consultation with hm two reputable practicing veterinarians veterinari-ans or physicians residents of the territory or i this is impossible then two reputable and wellknown stock owners residents of the territory ter-ritory and shall have the written endorsement upon his order of at least one of said consulting physicians or stock owners stating that said action Is necessary Sec 5 Whenever as herein provided the territorial veterinarian shall order the slaughter slaugh-ter of one or more animals he shall at the time of making such order notify in writing the nearest justice of the peace who shall thereupon there-upon summons three disinterested citizens who shall be stock owners of the neighborhood neighbor-hood to act as appraisers of the value of such animals Such appraisers before entering upon the discharge of their duties shall DO sworn to make a true and faithful appraisement appraise-ment without prejudice or lavor They shall after making their appraisement return certified certi-fied copies of their valuation u separate one being made for each owner together with an accurate description of such animal slaughtered slaugh-tered giving all brands ear marus wattles age sex and class as to whether American halfbreed or Texas to the justice of the peace by whom they are summoned who shall after entering the same upon his record and making au endorsement upon each showing it to have been properly recorded return it together with the duplicate order of the veterinarian to the person or persons owning the animal slaughtered slaugh-tered and it shall be the duty of the territorial veterinarian to superintend the slaughter of such animals as may be condemned and also the destruction of the carcass by burning to abhesnand shall include every part of the animal ani-mal and hideand also excrement as far as possible possi-ble He shall cause the saic1 saughter and burning to be done as cheaply as practicable and shall pay the expense from the contingent fund hereinafter provided taking hereinafer proper vouchers for the same Sec 6 The territorial veterinarian shall make a report at the end of every year to the governor of all matters connected with his work and the governor shall transmit to he < several boards of county commissioner parts of said report as may be of general interest inter-est to the breeders of live stock the governor shall also give information in writing as rap idly as he obtains it to the various boards of county commissioners of each cause of suspicion sus-picion or first eruption of disease in each locality lo-cality its course and the measures adopted to check it Sec 7 Whenever the governor the territory tory shall have good reason to believe that any disease covered by this aot has become epidemic epi-demic in certain localities in another state or territory or that the conditions exist which render domestic animals therein liable to convey con-vey disease he shall thereupon by proclamation proclama-tion schedule such localities and prohibit the importation from them of any live stock of the kind diseased into this territory except under I such restrictions as tie may deem proper Any corporation or any person or persons who after the publication of said proclamation shall knowingly receive in charge any such animal I ani-mal or animals from any ono of said prohibited districts and transport or convey the same within the limits of this territory shall be deamed guilty of a misdemeanor and upon conviction fined not less than SiOoO nor more than 51u000 for each and every offence and hall further become liable for any and all damages I dam-ages and loss that may be sustained by any I person or persons by reason of the importation or transportation of such nrohihltprt nnimnls Sec SIt shall be the duty of any personor persons who shall have or suspect that there is upon his or their premises any case of such ontagious or infectious disease among domestic do-mestic animals as numbered in section 10 of the act to immediately report seoton same to the territorial veterinarian and I fail ure to do or anv attempt to conceal the existence of such disease or to willfully or maliciously obstruct or resist the said veterinarian veter-inarian In the disouarge of his duty as herein before set forth shall be deemed a misde meaner and any person or persons who shall be fined in any sum less than O for each and every such offense shall forfeit all claims for indemnity for loss from the territory Sec 9 The following regulations shall be observed served in all cases of disease covered by t is act First it shall be unlawful to sell give away or in any manner part with any animal affected with or suspected of contagious or Infections in-fections disease and in the case of any animal that may be known to have been affected with or exposed to any such disease within one year prior to such disposal due notice of tho fact shall be given in writing to the party receiving the animal Second it shall bo unlawful to kill for butcher purposes any such animal to sell give away or use any part of i or its milk or to remove any part of the skin A fail ore to observe these conditions shall be deemed a misdemeanor and on conviction shall be pun ished by a fine in any sum less than 300 I hall be the duly of the owner or person having in charge any animal affected with or suspected of any contagious or infectious disease to immediately im-mediately confine the same in a safo place isolated ated from other animals and with all neces sary restrictions to prevent dissemination of the disease until the arrival of the territorial vet rinarian The above regulations shall apply as well to animals in transit through tee territory as to those resident therein and the territorial veterinarian or his duly authorized agnt hall have full authority to examine whether in car or yards or stables all animals passing through the territory or any part ol it and on election or suspicion of disease to take possession posses-sion of and treat and dispose of said animals in the same manner as is prescribed for animals resident in the territory Sec 10 All claims against the territory ads ing from the slaughter of animals under the provisions of this act shall together with the order of the veterinarian and the valuation of the appraisers in each case bo submitted to the territorial auditor who shall examine them without unnecessary delay and for each one that he finds to bo equitable and entitled to In demnity under this act shall issue his warrant on the territorial treasurer for the sum named in the appraisers report In auditing any claim under this act it shall be the duty of the auditor to satisfy himself that it does not come under any class for which indemnity in-demnity is refused by this act and he shall require re-quire the affidavit of the claimant to this fact and also the certificate of the veterinarian whose duty It shall be to inform himself fully of the facts that in his opinion the claim is legal and just and the auditor may at his discretion dis-cretion require further proof The indemnity to bo granted shall be two thirds tbd 5 ordinary value of thp animal as determined by the appraisers ap-praisers without reference to its diminished value because of being diseased It shall be paid to the owner upon his application and the presentation of the proofs prescribed herein and it shall be the duty of the owner to make such application within six months of the slaughter of the animal for which payment is claimed failing which such claim shall be barred by limitation These payments shall be paid by the terrltor lot treasurer as above provided and from the fund provided by this act The right to indemnify under this act Is limIted ted to animals destroyed by reason of the existence ex-istence or suspected existence of some epizootic disease generally fatal and incurable such as I rinderpest hoof and mouth disease pleuro pneumonia anthrax or Texas fever among bovines bo-vines glanders among horses and anthrax among sheep For the ordinary an diseases dis-eases not in their nature fatal such as scab or hoof rot in sheep and epizootic influenzas in horses no Indemnity shall be paid Tho right of indemnity shall not exist and payment of such shall not be made in the following fol-lowing cases 1lrst For animals belonging to the United States Second For animals that are brought into h < territory contrary to the provisions of this act Third For animals that are found to be diseased or that are destroyed because they have been exposed to disease be fore or at the time of their arrival in the territory terri-tory Fourth When an animal was previously affected by any other disease which from its nature na-ture and development was incurable and necessarily neces-sarily fatal Fifth When the owner or person in charge shall have knowingly or negligently omitted to comply with the provisions of sections sec-tions 8 and 0 ol this act Sixth When the owner or claimant at the time of coming in possession of the animal knew it to be diseased or received the notice specified in the first clause of section 9 of this net Sec 1 The territorial veterinarian shall receive re-ceive for his services the sum of 31200 per annum an-num together with his actual necessarv traveling trav-eling expenses when in the performance of his duty provided such oxpenses do not exceed S500 These payments shall be made from the funds provided by this act the salary from the appropriation for salary and the traveling expense ex-pense from the contingent fund upon vouchers signed and sworn to by him and approved by I the governor separate vouchers being made for salary and expenses No person shall be competent under this act to receive the ap pointment of territorial veterinarian who is not at the date of his appointment a graduate in good standing of a recognized college of veteri nary surgery I eerCo in tic United States Canada or Europe He shall hold his office for two years ho may be removed for cause by the tBosacancBiu shall also have tower t fill a vacancy The veterinarian is hereby authorized au-thorized in his discretion to appoint a deputy for the performance of whose duties the veterinarian veter-inarian shall be responsible and who shall exercise such powers as may be deputed to him by the territorial veterinarian Snch deputy shall receive not exceeding Sl per day rbr the time actually employed The appraisers herein provided for shall each receive 300 for each day or part of a day they may be actually employed as such which shall be paid from their county fund upon the certificate of the justice who summoned them The justice shall receive his ordinary fee for issuing a summons be paid out of the county fund veterinarians physicians or stock owners called i consultation consulta-tion by the veterinarian shall each receive S300 for each day or part of day they may ie actually so employed and 10 cents per mile mileage for distance actually traveled which sum shall be paid from the veterinarians conti gent fund hereafter provided For this and other incidental expenses connected with this work and made his duty by this act such as his traveling expenses causing animal to be slaughtered and their carcases burned and disinfecting infected premises the veterinarian shall have at his disposal the some of O which shall be known as the veterinarian con tigent fund before entering upon tho discharge of his duties he shall give good and sufficient surety in the sum of S5utO for the proper management of the same He shall make a sworn statement state-ment semiannually to the governor supported by vouchers of the amount disbursed any part of the 1000 not used shall be covered into the territorial treasury No constructive mileage shall be paid under this act Sec 12it shall be the duty each year of the territorial board of equalization at the time of making the annual assessment to levy a special tax not exceeding 1 mill on the dollar upon the asstssed value of all cattle sheep horses and mules in the territory to be known as the stock indemnity fund Said tax shall be levied and collected by the sevei al counties and paid to the territorial treasurer in the manner provided by law for levying collection and payment pay-ment of otner territorial taxes bald > fund shall constitute the indemnity fund specified by this chapter to be useu in paying for animals destroyed under the provisions thereof I shall be useo exclusively for that purpose and shall be paid out by the territorial treasurer as as hereinbefore provided for TiE DENTAL BILL The bill to regulato the practice of dentistry den-tistry came up on its third reading I forbids the practice of dentistry by anyone any-one who has not secured a diploma from some reputable dental college provides aboard a-board of five examiners whose duty it shall bo to enforce the provisions of the act makes every person engaged in the practice of dentistry in the territory within six months after the passage of the bill cause his or her name and residence or place
