Show IN COURT CIRCLES I The Registrars File Answers in the Mandamus Cases IK THE THIRD DISTRICT COURT Before Judge Anderson at Beaver Proceedings Proceed-ings in the Probate and Police Courts In the Third district court Judge Zau transacted the following business Eagle Foundry and Machine company vs F J Pascoe on motion of plaintiff the case was dismissed The case sf William Perego vs William H Dodge et al involving mining propert near Park City again occupied the atten tion of the court during the day Several witnesses for the defense were examined and the evidence is not all in yet Elias Morris vs Utah Lime and Cement company on motion of C W Bennett for defendant and P L Williams for plaintiff consenting a stay of execution is granted and defendant allowed ten days extension of time in which to prepare statement on motion for new trial THE MANDAMus CASES The following answer was yesterday filed in the mandamus case of John R Bock against Registrar Morris and similar answers were also filed in the other case I agimst Morris and also in the Clute case They are charged with refusing to register certain Peoples party voters IFor answer to the allegation in said writ and said affidavit that said plaintiff is and for seven years last past has been a resident of the third precinct of Salt Lake city territory of Utah said defendant says he has no information or belief sufficient Icient to answer said allegation he therefore r fes fdsalea wg L 1i fore denies said allegation that at all times thereafter mentioned he was and still is in all respects a qualified elector and entitled to representation in said precinct pre-cinct and citv Said defendant says he has no information or belief sufficient enable him to answer said allegation He therefore there-fore denies it d Denies that on the 26th day of November No-vember ISO or on any other dayat about IJ I oclock in the morning or at any other place the said plaintiff applied to the said defendant Morns such registrar or otherwise oth-erwise or demanded to be registered by said defendant Denies that said John H Bock plaintiff plain-tiff then or there or at any other time or at all informed said defendant of his said plaintiffs qualification or right to be registered regis-tered or offered to take or subscribe all or any oath prescribed by law or requested to be taken for the purpose of such registration registra-tion 5Denies that said defendant contrary to his duty as such registrar or ever since refused or still refuses to register or place the name of said plaintiff upon the registration regis-tration list of said election precinct or city 6 Denies that said defendant ever or at at any time ny at all refused to register said plaintiff as a voter of said precinct And now haYing fully answered said de endant prays to be hence dismissed with his reasonable costs in his behalf expended ex-pended The hearing in all three of the mandamus cases was set to coma on before Judge Zane as soon as the Perego mining case closes |
