Show THE TOFTS CASE The Defendant Held In 1000 to Answer f The case of The People vs El bridge G Tufts for the attempted murder of his brother Don C came up before Justice Speirs in the City Hall yesterday morning As the testimony of the prosecuting witness wit-ness states the whole case we produce pro-duce it entire Don C Tufts being duly sworn deposes and says I reside in Salt Lake city have been here about thirtysix years my age is 41 years I am a liquor dealer I know the defendant Elbridge Tufts I saw the defendant on the evening of the 14th at his residence when I came out of my residence to the sidewalk and walked west until I came to the front of his residence which is oa Third South street It was about5 oclock i or near that time It was perfectly I light He came out of his gate and met me He approached me in relation re-lation to three hogs that belonged to my mothers estate He asked me what I was going to do about it or something to that effect I told him I that I would render an account to him for those pigs when lie rendered ren-dered an account to me of a piano that he holds in his possession Then he said Ill be G dd if I will ever do it or that he would never do it He seemed to be very mad then and grabbed hold of me He said Then Im not to have any of those pigs JI I said Not until you render an account of the piano Then he used language which was too vulgar for me to repeat I called his attention to the language he used in the presence of his wife when he grabbed me somewhere by the collar and made another grab to catch me by the face In fact he did get his hand against my face and I backed away He drew back in an attitude to strike but didnt strike I put up my hand to caution him and to protect pro-tect myself in case he should strike I 1 told him then l would nave mm arrested I said hed done enough already to be arrested I cautioned him about the scrape hed been in before and said he was committing himself again I said Youve already had to pay dearly for what you did Thats about the sum and substance of the conversation that took place when I got away from him I got away and turned about half way around and made a kind of a motion with my hand and was then six or eight feet away from him I turned my back and walked as fast as I could I said no more to him and I dont know that he said anymore any-more to me I was walking fast and had heavy boots on and if he said anything 1 dont know what it was as soon as my back was turned I heard his wife scream as soon as she screamed I heard the report of a pistol the only warning was the stream of his wife when I heard the shot I kept right straight on my course didnt run and didnt dodge kept on my usual course the shot was repeated four other times in quick succession the shots i were fired while I was walking two rods dont know that it was two rods 1 did not turn around until I got to the corner I should say it was three or four rods from where I was when the last shot was fired to tb3 corner I then looked around and turned my head half way and saw defendant defend-ant with a pistol in his hand Ii crossed the road immediately and i came up here to the City Hall This occurred on the south side of Third South between First and Second East streets When I turned and left defendant I dont knew whether he was very angry but he was considerably mad when he grabbled me I was at one time about twenty feet irom defendant this was at the first shot at thelast shot I was about fifty feet James Newton and Elizabeth Gould were then successively placed upon the stand and testified substantially sub-stantially similar to the first witness wit-ness Defendant Tufts at this point waived further examination and he was bound over in the sum of 1000 to await the action of the grand jury |
