Utah New Law Key to Intensified Drive to Keep Drinking Drivers Off Rood i i. : This regulation, known as the "implied consent law," was described by Superintendent Lyle Hyatt of the Utah Highway Patrol as the keystone of the intensified campaign jdesigned to keep drinking drivers off the state's roads. During sessions at Brigham City and Farmington, as at the other meetings, the superintendent asked the troopers to study the "implied consent" law carefully and confer with local authorities officers and district and county attorneys so there would be "uniform enforcement." Hyatt said the patrol does not anticipate "too much trouble with first-tim- e violators," adding that "it's the repeaters who might challenge the new law and those are the guys we want to get off the road." Utah's law, the superintendent explained, is modeled after one already proven effective in New York. It provides that when any officer arrests a driver on suspicion of operating a car while intoxicated, the driver can be requested to take a chemical test to determine the percentage of alco hol in his bloodstream. Chemical Tests The tests are made from specimens of body fluids blood and urine. The law provides the blood can be withdrawn only by a physi- cian or authorized laboratory technician Hyatt is investigating the " practicality of a device that makes the test throdgh an analysis of the breath, and some may be purchased this year. If the driver refuses to take the test immediately since the alco "breath-o-meters,- holic content would diminish rapidly authorities will fill out a form noting the offense, its time and circumstances and forward the citation to the Driver's License Division of the Department of Public Safety. Such refusal, the law provides, will mean suspension of a license for one year, although the driver may appeal the suspension through the courts. Hyatt pointed out to the troopers action on actual drunk driving or if, despite outward evidence, they other criminal charges, but is a are not actually intoxicated.
