Gun-nison. The mix-up was brought about by the appointment of George Halverson, by the city council, to fill l he vacancy caused by the resignation resigna-tion of Anthony Madsen. The council coun-cil minutes show that Halverson's appointment was made to fill the vacancy, va-cancy, while the statutes provide that an appointment made shall be to fill the unexpired term. Madsen's term, had he not resigned, would not have expired until January 1, 1922. While llalverson was duly appointed ap-pointed as councilman to fill Madmen's Mad-men's unexpired term, yet at the primary pri-mary of the Citizens party, llalverson llalver-son was nominated for the four-year-lerm councilman, and still has two years yet to serve under his appointment. appoint-ment. Another conflicting point that has been brought about is the fact thai the Cit'zens party has nominated . four two-year councilmen, while the law provides for the election of three only. The law also provides that vacancies va-cancies in the city council be filled by appointment and there are no provisions pro-visions in the statutes authorizing the filling of vacancies for unexpired terms by elections. The statutes also provide that if a political party nominates more candidates can-didates than there are ofliecs to be filled at any election that only those names which come first in order on certificate of nomination and are equal in number, with the number of offices to be filled, shall bo taken as surplusages. The statutes provide further that when two or more officers of the same kind are to be elected, if more , squares opposite the names of candidates candi-dates for such office are marked than there are officers to be elected to such office, or if the aggregate number num-ber of unscratched candidates on a ticket, the circle of which is marked, added to the number of such candidates candi-dates on other tickets whose names aro marked, shall exceed the number of officers to be elected to such oilice, the ballot shall not lie counted for any .men candidate. |
