In sustaining a demurrer de-murrer to the application for a writ of mandamus. Judge N. J. Harris today rendered ren-dered a decision in favor of tho Ogden 1 city board of commissioners against the j "Jitney" Service company. The company sought a -writ through the district .court to force the commission to issue five mu-! mu-! nlcipal auto licenses for the operation of ! "jitney" busses in this city. Thft company not only instituted mandamus man-damus proceedings, but also sought damages dam-ages in the amount of S25 a day for four days, because of the commission's refusal to issue the licenses on application. In the demurrer of the city it was alleged that there had been a mis-joinder of the defendants in the complaint in that Commissioner Com-missioner Chris Flygarc was left out and Mrs. Florence O. Stanford, citv recorder, was included. It was also contended that the board has the right under the citv ordinances to refuse to issue municipal licenses. The "Jitney' company has not announced an-nounced its next stop. |
